Trump Fraud Judgment: Ex-President Says Posting Full $454 Million Bond Is ‘Not Possible’ As Deadline Looms

Former President Donald Trump is unable to secure a bond for the more than $454 million he owes as part of the civil fraud case against him and his company, the ex-president’s attorneys said Monday, as Trump asks a state appeals court to pause the judgment against him days before it comes due.

Trump has been ordered to pay $454.2 million in the civil fraud case, in which he and his business associates were found liable for fraudulently misstating the value of their assets on financial statements for personal gain.

That amount continues to grow by more than $111,000 each day until it’s paid off, based on a 9% annual interest rate, and Trump is still required to either pay cash into a court-controlled account or post an appeals bond while he appeals the case.

Trump’s attorneys asked the court to pause the judgment while the case is appealed in a filing Monday, saying that securing a bond for the full amount is a “practical impossibility.”

The attorneys argued Trump has undertaken “diligent efforts” to secure a bond and negotiated with “one of the largest insurance companies in the world,” but that’s proven “‘obtaining an appeal bond in the full amount’ of the Judgment is not possible under the circumstances presented.’”

Most bonding companies won’t consider a bond as large as what Trump needs, and those that do won’t accept real estate as collateral, Trump’s lawyers said.

Given interest rates and premiums, Trump would have to turn over approximately $557 million in cash or cash equivalents (like marketable securities) to secure a bond, according to his lawyers.

30. That’s the number of surety companies that Trump has unsuccessfully approached about his appeals bond, according to an affirmation filed in court by Trump Organization lawyer Alan Garten. None were willing to accept real estate as collateral.

What To Watch For

It’s unclear when the appeals court could rule on Trump’s request to pause the monetary judgment. The former president has previously asked the court to let him only post a $100 million bond, if it doesn’t halt the judgment entirely. Though there’s no deadline specified in New York law on Trump posting a bond, the New York Attorney General’s office, which brought the case, is expected to start trying to enforce the judgment if he hasn’t paid by March 25. Attorney General Letitia James has previously said she plans to seize Trump’s buildings if he doesn’t pay.

Forbes estimates Trump’s net worth at $2.6 billion—but only $413 million is made up of cash and liquid assets, meaning the judgment against Trump is more money than he has in the bank.

How Will Trump Pay?

It remains to be seen how Trump will pay the judgment against him or secure a bond if the appeals court rules against him, whether that’s borrowing against his properties, getting a wealthy friend to help him put up the cash or obtaining a loan. The former president’s lawyers have previously said in court filings that Trump will have to sell his properties if the court doesn’t pause the judgment. In Monday’s filing, attorneys noted that raising the money for a bond “through a ‘fire sale’ of real estate holdings would inevitably result in massive, irrecoverable losses.”

Trump’s scramble to secure a bond in the fraud case comes after the ex-president separately posted a $91.6 million bond earlier in March as part of writer E. Jean Carroll’s defamation case against him. That bond was underwritten by The Chubb Group, which defended its business with Trump to customers, claiming it has “nothing to do with the underlying merits or with favoring any of the parties” and that the company supports the rule of law. It is still unclear how Trump secured that bond, though Chubb CEO Evan Greenberg said it was “fully collateralized.”

James sued Trump and his business associates—including his sons—for fraud in 2022, accusing them of fraudulently misstating the value of assets on financial statements more than 200 times between 2011 and 2021. The attorney general alleged the valuations were misstated in order to obtain more favorable business deals, and obtain a higher net worth for Trump. While the ex-president and his co-defendants have argued their valuations were correct and were subjective figures based on Trump’s real estate expertise, Judge Arthur Engoron ruled against Trump even before the trial in the case began, finding the numbers were fraudulently inflated. A monthslong trial then took place on other allegations, such as whether the fraud was committed knowingly, and Engoron ruled against Trump and his co-defendants in February. The judge found there was “overwhelming evidence” suggesting Trump and his sons signed off on financial statements knowing the figures were false, rejecting the defendants’ claims that the company’s accountants were responsible for any issues with the numbers. In addition to the monetary judgment against Trump, Engoron also ordered Trump’s sons Eric and Donald Trump Jr. to pay approximately $4 million each and for former CFO Allen Weisselberg to pay $1 million. He also barred Trump and his sons from leading New York companies for three and two years, respectively, and barred Trump from obtaining loans through companies registered in New York, though an appeals court later put that part of the judgment on hold.

Trump has been unable to get bond for $464 million judgment, his lawyers say

Former President Donald Trump has not been able to get a bond to secure the $464 million civil fraud judgment against him and his co-defendants, his lawyers said in a court filing Monday.

Trump and his company need to post a bond for the full amount by next week in order to stop New York Attorney General Letitia James from being able to collect while he appeals . They've asked an appeals court to step in in the meantime and said Monday that they have not had any success getting a bond.

"Defendants’ ongoing diligent efforts have proven that a bond in the judgment’s full amount is 'a practical impossibility,'" the filing said. "These diligent efforts have included approaching about 30 surety companies through 4 separate brokers."

Their efforts, including “countless hours negotiating with one of the largest insurance companies in the world,” have proven that “obtaining an appeal bond in the full amount” of the judgment “is not possible under the circumstances presented,” the filing said.

The other bond companies will not “accept hard assets such as real estate as collateral,” but “will only accept cash or cash equivalents (such as marketable securities),” the filing said. The lawyers also noted those companies typically “require collateral of approximately 120% of the amount of the judgment” — which would total about $557 million.

"In addition, sureties would likely charge bond premiums of approximately 2 percent per year with two years in advance—an upfront cost over $18 million," the filing said. That $18 million would not be recoverable even if Trump wins his appeal.

In all, the filing said, the "actual amount of cash or cash equivalents required 'to collateralize the bond and have sufficient capital to run the business and satisfy its other obligations' approach[es] $1 billion."

While the filing says Trump can't afford the bond, it also argues that the attorney general doesn't have to worry about being able to collect her judgment.

"Defendants’ real estate holdings — including iconic properties like 40 Wall Street, Doral Miami, and Mar-a-Lago, — greatly exceed the amount of the judgment. Such assets are impossible to secrete or dispose of surreptitiously, leaving the plaintiff effectively secured during the pendency of an appeal," the filing said.

Trump's team also argued the $464 million penalty is "grossly disproportional" and cited the argument they made throughout the monthslong trial that "there are no victims, as there were no damages and no financial losses." 

In a filing last month, Trump's lawyers asked that the bond amount be reduced to $100 million, but Monday's filing argues he shouldn't have to put up any bond at all.

James' office has argued that Trump should put up the full amount.

A 30-day automatic stay of the judgment handed down by Judge Arthur Engoron is set to expire March 25, at which point James would be clear to start seizing Trump's assets unless the appeals court steps in.

James would not need an additional court order to start collecting in New York, where Trump has his company and a large number of real estate assets, but those efforts could be complicated by any mortgages or debts he has on those properties. It’s unclear what properties or assets James might look to seize.

Steven Cheung, a spokesman for Trump's campaign, said in a statement that the judgment is "unjust, unconstitutional" and "un-American."

"A bond of this size would be an abuse of the law," he said.

Trump asked that if the state Appellate Division denies his request, the judges enter a temporary stay so he can try to make his case to the state's highest court, the Court of Appeals.

Engoron handed down his judgment last month after finding Trump and his company had repeatedly committed fraud by overinflating personal financial statements that he used to secure bank loans and insurance policies. James' office said there were years when Trump's assets were overvalued by more than $2 billion.

Trump maintained he did nothing wrong and testified that, if anything, his properties were undervalued.

The judge hit Trump and his co-defendants with a judgment saying they had to pay over $350 million — an amount that ballooned to $464 million with pre-judgment interest. Of that amount on the date the judgment was entered, the vast majority, or about $454 million, was against Trump and his companies.

That amount has grown since — the judgment against Trump will increase at a daily rate of nearly $112,000 until it’s paid off because of interest on the penalty, according to the attorney general’s office.

The filing Monday seeking to freeze the entire $464 million was filed on behalf of Trump and his co-defendants, including his sons Don Jr. and Eric, who've been running the Trump Organization since their father first went to the White House.  

In a separate case in New York federal court, Trump last week posted a $91 million bond to secure writer E. Jean Carroll's $83 million defamation judgment against him while he appeals that verdict as well.

Vietnamese President Vo Van Thuong resigns amid anti-corruption campaign

HANOI, Vietnam — (AP) — Vietnamese President Vo Van Thuong resigned after a little over a year in the position, the Communist Party said Wednesday, making him the latest senior official to leave office after likely being implicated in an intense anti-corruption campaign.

The party said it had accepted his resignation, writing in a statement that “violations by Vo Van Thuong have left a bad mark on the reputation of the Communist party.”

Thuong is the second president to resign in two years, something analysts called a worrying sign for political stability in a country that plays a key role in the middle of U.S.-China competition and a growing one in global manufacturing.

His resignation came after weeks of rumors suggesting that he would be removed from office, and on the eve of a special session of Vietnam's parliament dedicated to “personnel matters.”

Days earlier, Vietnamese police said they arrested the former head of Central Vietnam’s Quang Ngai province for corruption. He was previously supervised by Thuong as the provincial party chief.

Thuong, 54, became president in March 2023, two months after his predecessor Nguyen Xuan Phuc resigned to take "political responsibility" for corruption scandals during the pandemic. He was the youngest president since modern day Vietnam emerged from war in the mid-1970s.

The position of president in Vietnam is largely ceremonial and ranks third in the country’s political hierarchy. The most powerful position is that of Communist Party general secretary, a post held since 2011 by Nguyen Phu Trong, who is 79.

The ideologically conservative Thuong was considered Trong's protege, and his departure underscores the reach of the anti-corruption drive that has been Trong’s “most important legacy,” said Nguyen Khac Giang, an analyst at Singapore’s ISEAS-Yusof Ishak Institute.

Truong's "violations" had "negatively affected public perception, as well as the reputation of the Party and the state. Being aware of his responsibilities before the Party, the state and the people, Thuong has sent his resignation from his positions," a party statement reported by state media VN Express International said.

The announcement precedes a meeting in Hanoi of Vietnam’s parliament scheduled for Thursday, when it is likely to approve the party’s decision to accept the resignation. It is unlikely that a permanent replacement would be elected very soon, Giang added.

It wasn’t clear what the exact nature of the violations was but Thuong’s resignation took place days after the former head of Central Vietnam’s Quang Ngai province was arrested on allegations of corruption while Thuong was party chief in the province. The former head was part of an investigation into a real estate firm for alleged forgery.

The fact that the alleged violations were reported by the Central Inspection Commission, the Communist Party’s mechanism for carrying out the anti-corruption campaign, implied that Thuong was “implicated in the anti-corruption” campaign, Giang said.

The news of Thuong's resignation broke in the evening when the streets of Hanoi were filling up with people returning from work. Almost everybody was on their phones, from young students in cafes to guards outside ancient monuments. The narrow winding lanes of the city’s Ba Dinh district echoed with the sounds of televisions.

The anti-corruption drive, described by Trong as a “blazing furnace,” has helped cement the top leader's authority, but Giang said that factions in the party have also sought to use it to purge rivals.

Analysts have warned that the anti-corruption drive has hurt Vietnam's business environment , making foreign investors jittery about unpredictable economic policies.

Vietnam has tried to strike a balance between its larger neighbor China and the U.S. while positioning itself as an ideal home for businesses looking to shift their supply chains out of China. Last year it was the only country that received both American President Joe Biden and China’s Xi Jinping on state visits.

The campaign has also meant a significant rise in the power of both state and party enforcement agencies.

Rumors of a potential political change flared after a state visit to Vietnam by the Dutch royal family was postponed due to “due to domestic circumstances,” according to a statement from the Dutch Royal house.

The World Bank president likewise put off a visit planned for this week.

Trading volume on Vietnam’s stock exchanges hit a record high on Monday as investors speculated over the president's future.
