We are proud to present AWARE, a yacht concept where space optimization is leading and with an open eye for space, inside-outside connection to the sea, comfortable lounges and vast exterior decks. AWARE is the Essence of Luxury, a logical step in yacht design where all the available space is used to give owners and guests the best possible experience. The result is a yacht concept of simple grandeur, revealing its nature with outspoken honesty: a focus on the spacious experience aboard and connection with the sea.

Space optimization comes first: a huge beach aft of 230m2 with an 11-meter-long pool. A Beach Club with an internal height of 3 meters plus a full beam 80m2 OSR with a private lounge and balcony featuring its own jacuzzi. At bridge deck a vast 460m2 exterior, while the lounges, dining, and wheelhouse in the bridge deck pavilion cover 200m2. The number of decks has been slimmed down to a lower deck, a main deck, and a bridge deck with flexibility of use ensured by the effcient open plan layout.

Abundance of space.

“For AWARE the focus is on space optimization and functionality, maximizing the space on board. Superfluous corridors are omitted, ceiling heights are optimized (3 meters at the beach club and 2,5 meters at the pavilion), the open plan layouts offer inherent flexibility and ample space. Throughout AWARE’s interior, elegance and luxury are combined with authentic quality and unique materials. The minimalistic, pure design language is developed to be in mindful harmony for owners, guests and the natural environment.

Careful use of proportions in both the exterior and interior of AWARE has resulted in a pure space experience. Light is used as a tool to set interior moods using shutters, adjustable blinds and grids to allow different levels of daylight admittance. AWARE combines a superior quality of build with a sophisticated use of natural materials resulting in an essential design atmosphere that creates a holistic awareness of the yacht for a true connoisseur owner.”

ARCHITECTURAL GEOMETRY

Triple deck yacht design.

With a LOA of 79,9 meters and a height of just 8 meters above the waterline, the low profile of AWARE is elongated and elegant. All lounges, interior spaces and exterior decks are proportioned to provide ultimate functionality and an optimal inside-out experience. The nautical platform consists of three decks, with an open plan pavilion on the bridge deck offering unrestricted views of the ocean at all sides.

Connection with the water on all decks is all-encompassing thanks to the unobstructed exterior decks, the floor-to-ceiling windows, extensive glass facades and two huge fold-down hatches at the Beach Club. Located at the aft of the main deck aft, the Beach Club delivers 230m2 of partially shaded space and incorporates an 11 meters long pool. Sunbeds and loungers are positioned to allow for plenty of walk-around space for having fun by the pool. The aft deck offers access to the sea for water sports and toys or for serving as a mooring spot for one of the tenders onboard AWARE.

Sea level indulgence

AWARE’s Beach Club is a multi-purpose space to work out, enjoy yoga or beauty treatments or to just come together for al-fresco dining on the lowered hatch or for drinks at the bar. Two floor-to-ceiling hatches on the starboard and port side fold down to enlarge the space to a level-floored 121m2. The interior ceiling height of 3 meters guarantees awareness of the sea when the hatches are open, merging ocean views with the interior space experience.

The Beach Club is accessible in several ways; directly from the exterior main deck aft, under the overhang by passing through the floor-to-ceiling doors, and by the central staircase lobby. Once at the Beach Club, an interior cinema setting can be enjoyed, while flexible space dividers are used to provide private settings for well-being activities of any kind. Comfortable lounge seating caters for any type of relaxation and social gathering for smaller or larger groups.

Owner’s state room

Dreamtime delights.

Located forward at the main deck of AWARE, the beam-wide owner’s state room offers 80m2 of living, sleeping, bathroom and dressing space. Expansive full-length windows create an impression of vast openness and freedom. The open plan arrangement combines a bedroom with a lounge and adjacent balcony where glass sliding doors and a glass bulwark provide a seamless transition from inside to outside. The built-in open-air jacuzzi tub situated in a corner of the balcony is the epitome of style.

A combined bathroom and dressing space for the owner’s state room optimizes the efficiency of space usage. Hand-crafted sliding doors with inserts of clear glass and bleached wenge offer privacy and division. The bathtub is crafted out of a single block of natural onyx stone, hand-worked for a softened effect to match the backdrop of the natural limestone surface. All the features in the owner’s state room consist of custom-designed pieces, hand-crafted from durable and natural materials.

Guest state room

Mindful hospitality.

Four grand guest state rooms are located around AWARE’s central staircase lobby. All the rooms have full-length windows delivering an infinite connection with the surrounding seascape. Each bedroom has an ensuite bathroom also featuring full-length windows furnished with adjustable blinds, a floating onyx vanity and separate shower and toilet cabins with onyx walls, floors, and ceiling panels.

Inside the guest spaces, every detail of the design has been examined, with painstaking attention devoted to form, material selection, finishes and functionality. The selection of natural stones and hand-picked timbers allows for further personalization of AWARE’s interior, ensuring the design is aesthetically balanced with inherent appeal. The result is an atmosphere of pleasing intimacy and mindful hospitality.

Central staircase

Connect the decks.

One of the highlights of AWARE is the central circular staircase connecting the lower deck, main deck, and bridge deck onboard. With its sculptural design and position in a glass-covered vide, the stairs seem to float freely in space, creating an impression of monumental weightlessness. The wooden ring that almost invisibly connects the stairs to the upper deck pavilion, is reflected in the large oculus skylight in the ceiling of the bridge deck pavilion.

The elegance of the staircase is portrayed by stringers in the textured wood, where interlocking spirals provide the required structural stability for the leather-clad steps. Full-glass balustrades with polished edges are located both at the steps and at the landings, strengthening the upward-directed motion of the staircase by their sweeping curving lines. The staircase’s overall configuration is a statement of the pure design language onboard AWARE.

Bridge deck pavillion

Free-flowing spaciousness.

On the bridge deck a vast 460m2 exterior deck surrounds the pavilion to fully enjoy views of the sea. Inside, a lounge, dining, library, and semi-open wheelhouse are integrated in one free-flowing space of almost 200m2. When ascending the grand circular staircase, the oculus in the central lobby lights the route towards the aft lounge, where a seating arrangement of comfortable sofas is situated. The open connection to the aft and side deck exteriors makes dining and lounging a true al-fresco experience.

Yacht designer Ron Holland

Yacht designer Ron Holland celebrated two milestones in 2008 – his 60th birthday and 33 years in his chosen profession. Since these events always stir up reflection, it is a good time to get his insight on the growth of the industry and how he sees his role in its development, past and future.

‘Some key things happened,’ he says. ‘When I finished school I went to work for a builder of wooden boats, and that became a sort of foundation in the way I approached design in my career. I was in my 20s, just starting out, and my approach was more practical than theoretical or academic.

‘It was the 60s and the superyacht almost didn’t exist. There were a handful, maybe, of big yachts but nothing really under construction. It has been amazing to see the whole industry undergo a dramatic change.’

Holland began with designing and sailing successful racing yachts in international regattas: the Admiral’s Cup and the Fastnet Race. Performance was a big part of the achievements of Ron Holland Design.

The studio moved on to designing the Maxi race yachts Kialoa and Condor , which, at 24.4m, were the largest racing yachts being built at the time. For Holland these were the stepping stone to the new generation of big sailing yachts.

‘We did two projects, both sort of influenced by racing success. One was in Europe, called Whirlwind XII , and it was the first 30.5m that I designed and the first built by Royal Huisman shipyard. Both of our organisations were at the leading edge of those first steps into 30m-plus private yachts,’ recalls Holland.

‘The second boat we did, in parallel almost, is now called_ Avalon_, built in New Zealand – the first over 30.5m to be built in that country. These two boats were defining moments for my organisation. I thought that’s it, this is the ultimate, it’s never going to be bigger or better. We could never have imagined what was to follow in the next 20 to 25 years. It has been extraordinary.’

The two boats had an impact on the luxury market because they showed that it was possible to have a level of comfort beyond what traditional, classic sailboats could offer, even large boats. They were more stable, heeled over less and had more volume, and their interiors were reminiscent of motor yachts.

At the same time a revolution was going on in equipment. Mast riggers, sail makers and hardware manufacturers were bringing out new products that enabled large yachts to be sailed by small crews.

The increase in the motor yacht market is one of the most dramatic trends of the last 10 years.

‘I think it has to do with the spread of wealth,’ says Holland. ‘It has enabled people who traditionally would not consider owning a yacht, who haven’t a background in boating like most sail yacht owners but have made a lot of money, to enter the market as a passion or pastime. The automatic response is to get a powerboat. It is simpler and more logical.’

However, although up to 400 boats of over 30m are being built at the moment around the world, only a small percentage of the people who can afford a private yacht have actually bought one, which leads him to believe that superyachts will continue to be an important growth industry: ‘I don’t think we are anywhere near the limit.’

Holland believes it is right, while bearing safety in mind, to fulfil his clients’ dreams and goals.

‘I had to face this when we did Mirabella V . Previously we had the tallest mast on Felicitá West , a Perini 210 ketch. We thought, ah, it’s the master of the world. Then Joe Vittoria came along for Mirabella V and said he wanted a sloop,’ Holland explains.

‘ Mirabella ’s mast is easily 30m higher than anything around. I did say to myself, can we do this, is it reasonable? From an engineering point of view, yes, we certainly can, and if that is what the client is asking for, we can fulfil it.

‘People need to remember that with projects like _Mirabella V _and the 120m motor yachts being built, a great thing is happening and that is the distribution of wealth. This is a hell of a good way for wealthy people to feed money back to a wide variety of craftsmen. Building a complex yacht touches more aspects of engineering and services than any other single industry.’

Probing further into the subject of Mirabella V , how was the experience?

‘It really was a once-in-a-lifetime project. Every time I walked into the shed when they were building it, it was breathtaking to see how big and magnificent the thing was. I can’t say it was something I dreamed about because when we were doing Whirlwind and Avalon we could never imagine 76m sailboats. It was just that a courageous client gave us the opportunity to put our experience and knowledge into fulfilling his dream and it was a wonderful chance to be involved.’

Beauty is paramount in Holland’s designs, even though he is focused on fulfilling the client’s dream.

‘I don’t want to sacrifice the aesthetic solution around what the client is trying to do,’ he says. ‘I put that ahead of everything else. When the boat is launched or anchored in a bay and you look back from the beach, it has to look great.’

Today, ecological issues and spiralling costs enter any discussion with a yacht designer about the future of the industry.

‘I mean, $100 a barrel for oil must be an influence, even if it is not apparent at the moment. Certainly there is awareness, ecological or even just efficiency awareness, among designers, builders and equipment manufacturers. For the first time we are seriously looking at how to be more efficient in the use of materials.’

The company has designed a 45.72m motor yacht, Marco Polo , a single screw explorer that has a fuel efficient advance of 34 litres an hour, a huge advantage over conventional twin screw motor yachts. Even commercial ships are using one large diameter propeller rather than multiple propellers because the efficiency gain is huge.

‘Still, we have seen a lot of resistance to the concept because of the psychological thing of one engine versus two, despite the fact that we can offer almost a 30 per cent reduction in fuel – a big cost saving over an ocean-going yacht’s lifespan. Clients feel that having two of everything is safer.’ Ron Holland Design is focusing on designing motor yachts with hull shapes that are very low resistant and sea-kindly, have a nice motion in rough water, and are designed with the same sophistication as racing boats.

‘I don’t see any pioneering stuff going on – I think there is a refinement of the things we have already done. I really don’t have any desire to do something really wild.’

He is, however, working on a project for a super-trimaran, close to 91m, with a very low resistant hull form, for fuel efficiency, and a ‘gigantic’ living space.

Holland has enough motivation to keep designing yachts for years to come. ‘I think my motivation goes back to when I was a kid, about eight or 10 years old,’ says Holland. ‘I had my little sailing dinghy and I imagined that I was Captain Cook exploring New Zealand. The motivation was the exploration, the sailing across the ocean with a wind-driven ship, and it is amazing how that is still as solid today. My whole life has been about sailing, from a little kid to now, that’s me. Sailboats are something I will do until the day I die, hopefully.’

A TWIST OF FATE

Born in Auckland, New Zealand, Ron Holland became enchanted with sailing at an early age. Ron’s father bought him a sailing dinghy for his 7th birthday. Ron recalls feeling upset because he really wanted a rowing dinghy, not a sailing dinghy, as he was afraid it would tip over. Sure enough, on their first trip out the boat capsized, and a local fisherman picked up a terrified Ron and brought him to shore.

“That little ‘P’ class dinghy was the same kind that all the Olympians and world-class New Zealand yachtsmen of that generation started out on. It was a famous little boat!” A year later Ron and his family moved to the east coast where he developed an almost feverish passion for sailing and became immersed in the local sailing community.

A RACE TO SKETCH

By age 13, Ron was a well-known crew member of several successful racing yachts. At age 15, he had the opportunity crew the 36-foot ketch “ Aloha “, sailing from Auckland to Sydney: 1,000 miles across the unpredictable Tasman Sea.

He obtained an apprenticeship with boat builder Keith Atkinson that included classes at Auckland Technical Institute. Two teachers, Peter Peal and Allan Wright, recognized his drawing and designing abilities. With their support and encouragement, Ron’s focus shifted from boat building to designing.

At 19, Ron received his first commission to design a 26-foot yacht, “ White Rabbit “, and the ensuing success led to further commissions in Auckland.

In 1968, at age 21, Ron was invited to San Francisco where he worked as a Design Draftsman with celebrated American yacht designer, Gary Mull. He was introduced to some of the top sailors in California and began crewing with some of the world’s most competitive international sailors.

“In those days racing was my obsession. I always had the next regatta in mind.”

Racing became second nature to Ron. He designed and built his own Quarter Tonner – “ Eygthene “, with which he won the USA Quarter-Ton Regatta in St. Petersburg, Florida, earning the opportunity to enter – and win! – the World Championship Quarter-Ton Cup in England in 1973. As word of his design skills spread, an Irish yachtsman sought out Ron to design “ Golden Apple “. This led him to open Ron Holland Design studio in County Cork, Ireland in 1974.

TODAY AND BEYOND

Ron’s innovative designs have repeatedly shaken up the yacht racing world. Ron Holland Design became one of the world’s leading yacht designers and the creator of a new generation of custom 100ft (30 metre)-plus performance superyachts in the early 1980’s.

A working relationship developed between Ron Holland and Perini Navi during the design and construction of the 64 metre (210 ft) ketch “ Felicita West” : at the time, the largest aluminum yacht ever to be built. This construction  commenced in 1998 with the yacht launching early 2003 in Viareggio, Italy. Giancarlo Ragnetti, managing Perini Navi, oversaw a series of 56-metre yachts with ten of these design collaborations launched. This led to a Ron Holland Design – Perini Navi Design collaboration, delivering 23 yachts to date with a 60-metre ketch presently under construction at the Viareggio shipyard.

In 2018 Ron Holland published his memoir: All The Oceans . Ron gave over 50 promotional presentations including Vancouver, BC, New Zealand, Australia, Singapore, and Hong Kong. During the Monaco Yacht Show, Ron held a book launch reception aboard “ Perseus^3″ : a Ron Holland – Perini Navi 60-metre sloop. USA events included Chicago and stops on both coasts, followed by presentations in England and Ireland; an opportunity to reconnect with lifetime friends and crewmates who contribute to the story.

The latest Ron Holland Design in development is a 42-metre schooner for long-time sailing yacht clients. Combining classic rig elements with state of the art design and construction, it truly is a yacht for all seasons.

For Ron, that’s the joy of it: to take a paper sketch and turn it into a luxurious, high performance work of nautical art. Ron’s commitment pays off at that exquisite moment when his latest design first hits the water.

Ron has created some of the fastest, most luxurious, award winning sailing yachts afloat – his studio has also designed several significant ocean voyaging motor yachts, combining modern technologies with tradition.

One of Ron Holland Design’s Motor Yachts is the 45-metre “ Dorothea III” . With extensive ocean passages across both the Pacific and Atlantic Oceans to her credit, this design has proven to be safe, comfortable and highly efficient. In 2020, “ Dorothea III” won the Boat International Media’s “Voyager’s Award”.

Ron Holland

My first design, the 26 ft. sloop ‘White Rabbit’ was created in 1966 during the 3 year period I attended my boat building apprenticeship in Auckland, New Zealand. Six years later, while working in the engineering department of production yacht builder, Morgan Yachts in St. Petersburg, Florida, I designed a 24 ft. racer, ‘Eygthene’, to the IOR Quarter Ton Rule. This yacht won the 1973 Quarter Ton Championships in Torbay, England, and enabled me to secure the design commission for ‘Golden Apple’ from Irish yachtsman, the late Hugh Coveney. The success of this yacht was the foundation of my Irish based yacht design business. These small racing yachts formed the backbone of the Ron Holland organisation for several years, with a string of successes in level rating world championships and Admiral’s Cup events. Racing at the highest level of international competition. Based on the racing success of the Admiral’s Cup yachts came commissions for maxi racers, the largest yachts competing internationally. In 1980, ‘Kialoa’ and ‘Condor’ established the Ron Holland design philosophy in this area of the business and lead to commissions for larger, performance oriented cruising yachts. ‘Whirlwind XII”, my first design over 100 ft. in length, was launched from the Royal Huisman Shipyard in 1986 and paved the way for a wide variety of design commissions from clients who demanded beautiful, safe, comfortable cruising yachts, capable of worldwide voyaging. The common denominator is these were all performance oriented cruising yachts, the benchmark of the Ron Holland Design philosophy still in force with today’s design commissions. 1999 has seen important new projects that included my first interior design commission, as well as my first motor yacht design work. New areas of activity that I have found stimulating and a logical extension of a lifetime’s work in the marine design field. Reviewing the presented Ron Holland designs will show the variety of design approaches that have been taken, specifically to ensure my clients achieve a yacht that fulfils their personal requirements. My organisation prides itself with interpreting the client’s goals and integrating these with aesthetically correct and performance oriented design solutions.

The Concept of a Contract Assignment

Contracts create rights and duties. By an assignment , an obligee (one who has the right to receive a contract benefit) transfers a right to receive a contract benefit owed by the obligor (the one who has a duty to perform) to a third person ( assignee ); the obligee then becomes an assignor (one who makes an assignment).

The Restatement (Second) of Contracts defines an assignment of a right as “a manifestation of the assignor’s intention to transfer it by virtue of which the assignor’s right to performance by the obligor is extinguished in whole or in part and the assignee acquires the right to such performance.”Restatement (Second) of Contracts, Section 317(1). The one who makes the assignment is both an obligee and a transferor. The assignee acquires the right to receive the contractual obligations of the promisor, who is referred to as the obligor (see Figure 14.1 "Assignment of Rights" ). The assignor may assign any right unless (1) doing so would materially change the obligation of the obligor, materially burden him, increase his risk, or otherwise diminish the value to him of the original contract; (2) statute or public policy forbids the assignment; or (3) the contract itself precludes assignment. The common law of contracts and Articles 2 and 9 of the Uniform Commercial Code (UCC) govern assignments. Assignments are an important part of business financing, such as factoring. A factor is one who purchases the right to receive income from another.

Method of Assignment

Manifesting assent.

To effect an assignment, the assignor must make known his intention to transfer the rights to the third person. The assignor’s intention must be that the assignment is effective without need of any further action or any further manifestation of intention to make the assignment. In other words, the assignor must intend and understand himself to be making the assignment then and there; he is not promising to make the assignment sometime in the future.

Under the UCC, any assignments of rights in excess of $5,000 must be in writing, but otherwise, assignments can be oral and consideration is not required: the assignor could assign the right to the assignee for nothing (not likely in commercial transactions, of course). Mrs. Franklin has the right to receive $750 a month from the sale of a house she formerly owned; she assigns the right to receive the money to her son Jason, as a gift. The assignment is good, though such a gratuitous assignment is usually revocable, which is not the case where consideration has been paid for an assignment.

Acceptance and Revocation

For the assignment to become effective, the assignee must manifest his acceptance under most circumstances. This is done automatically when, as is usually the case, the assignee has given consideration for the assignment (i.e., there is a contract between the assignor and the assignee in which the assignment is the assignor’s consideration), and then the assignment is not revocable without the assignee’s consent. Problems of acceptance normally arise only when the assignor intends the assignment as a gift. Then, for the assignment to be irrevocable, either the assignee must manifest his acceptance or the assignor must notify the assignee in writing of the assignment.

Notice to the obligor is not required, but an obligor who renders performance to the assignor without notice of the assignment (that performance of the contract is to be rendered now to the assignee) is discharged. Obviously, the assignor cannot then keep the consideration he has received; he owes it to the assignee. But if notice is given to the obligor and she performs to the assignor anyway, the assignee can recover from either the obligor or the assignee, so the obligor could have to perform twice, as in Exercise 2 at the chapter’s end, Aldana v. Colonial Palms Plaza . Of course, an obligor who receives notice of the assignment from the assignee will want to be sure the assignment has really occurred. After all, anybody could waltz up to the obligor and say, “I’m the assignee of your contract with the bank. From now on, pay me the $500 a month, not the bank.” The obligor is entitled to verification of the assignment.

Effect of Assignment

General rule.

An assignment of rights effectively makes the assignee stand in the shoes of the assignor. He gains all the rights against the obligor that the assignor had, but no more. An obligor who could avoid the assignor’s attempt to enforce the rights could avoid a similar attempt by the assignee. Likewise, under UCC Section 9-318(1), the assignee of an account is subject to all terms of the contract between the debtor and the creditor-assignor. Suppose Dealer sells a car to Buyer on a contract where Buyer is to pay $300 per month and the car is warranted for 50,000 miles. If the car goes on the fritz before then and Dealer won’t fix it, Buyer could fix it for, say, $250 and deduct that $250 from the amount owed Dealer on the next installment (called a setoff). Now, if Dealer assigns the contract to Assignee, Assignee stands in Dealer’s shoes, and Buyer could likewise deduct the $250 from payment to Assignee.

The “shoe rule” does not apply to two types of assignments. First, it is inapplicable to the sale of a negotiable instrument to a holder in due course. Second, the rule may be waived: under the UCC and at common law, the obligor may agree in the original contract not to raise defenses against the assignee that could have been raised against the assignor.Uniform Commercial Code, Section 9-206. While a waiver of defenses makes the assignment more marketable from the assignee’s point of view, it is a situation fraught with peril to an obligor, who may sign a contract without understanding the full import of the waiver. Under the waiver rule, for example, a farmer who buys a tractor on credit and discovers later that it does not work would still be required to pay a credit company that purchased the contract; his defense that the merchandise was shoddy would be unavailing (he would, as used to be said, be “having to pay on a dead horse”).

For that reason, there are various rules that limit both the holder in due course and the waiver rule. Certain defenses, the so-called real defenses (infancy, duress, and fraud in the execution, among others), may always be asserted. Also, the waiver clause in the contract must have been presented in good faith, and if the assignee has actual notice of a defense that the buyer or lessee could raise, then the waiver is ineffective. Moreover, in consumer transactions, the UCC’s rule is subject to state laws that protect consumers (people buying things used primarily for personal, family, or household purposes), and many states, by statute or court decision, have made waivers of defenses ineffective in such consumer transactions . Federal Trade Commission regulations also affect the ability of many sellers to pass on rights to assignees free of defenses that buyers could raise against them. Because of these various limitations on the holder in due course and on waivers, the “shoe rule” will not govern in consumer transactions and, if there are real defenses or the assignee does not act in good faith, in business transactions as well.

When Assignments Are Not Allowed

The general rule—as previously noted—is that most contract rights are assignable. But there are exceptions. Five of them are noted here.

Material Change in Duties of the Obligor

When an assignment has the effect of materially changing the duties that the obligor must perform, it is ineffective. Changing the party to whom the obligor must make a payment is not a material change of duty that will defeat an assignment, since that, of course, is the purpose behind most assignments. Nor will a minor change in the duties the obligor must perform defeat the assignment.

Several residents in the town of Centerville sign up on an annual basis with the Centerville Times to receive their morning paper. A customer who is moving out of town may assign his right to receive the paper to someone else within the delivery route. As long as the assignee pays for the paper, the assignment is effective; the only relationship the obligor has to the assignee is a routine delivery in exchange for payment. Obligors can consent in the original contract, however, to a subsequent assignment of duties. Here is a clause from the World Team Tennis League contract: “It is mutually agreed that the Club shall have the right to sell, assign, trade and transfer this contract to another Club in the League, and the Player agrees to accept and be bound by such sale, exchange, assignment or transfer and to faithfully perform and carry out his or her obligations under this contract as if it had been entered into by the Player and such other Club.” Consent is not necessary when the contract does not involve a personal relationship.

Assignment of Personal Rights

When it matters to the obligor who receives the benefit of his duty to perform under the contract, then the receipt of the benefit is a personal right that cannot be assigned. For example, a student seeking to earn pocket money during the school year signs up to do research work for a professor she admires and with whom she is friendly. The professor assigns the contract to one of his colleagues with whom the student does not get along. The assignment is ineffective because it matters to the student (the obligor) who the person of the assignee is. An insurance company provides auto insurance covering Mohammed Kareem, a sixty-five-year-old man who drives very carefully. Kareem cannot assign the contract to his seventeen-year-old grandson because it matters to the insurance company who the person of its insured is. Tenants usually cannot assign (sublet) their tenancies without the landlord’s permission because it matters to the landlord who the person of their tenant is. Section 14.4.1 "Nonassignable Rights" , Nassau Hotel Co. v. Barnett & Barse Corp. , is an example of the nonassignability of a personal right.

Assignment Forbidden by Statute or Public Policy

Various federal and state laws prohibit or regulate some contract assignment. The assignment of future wages is regulated by state and federal law to protect people from improvidently denying themselves future income because of immediate present financial difficulties. And even in the absence of statute, public policy might prohibit some assignments.

Contracts That Prohibit Assignment

Assignability of contract rights is useful, and prohibitions against it are not generally favored. Many contracts contain general language that prohibits assignment of rights or of “the contract.” Both the Restatement and UCC Section 2-210(3) declare that in the absence of any contrary circumstances, a provision in the agreement that prohibits assigning “the contract” bars “only the delegation to the assignee of the assignor’s performance.”Restatement (Second) of Contracts, Section 322. In other words, unless the contract specifically prohibits assignment of any of its terms, a party is free to assign anything except his or her own duties.

Even if a contractual provision explicitly prohibits it, a right to damages for breach of the whole contract is assignable under UCC Section 2-210(2) in contracts for goods. Likewise, UCC Section 9-318(4) invalidates any contract provision that prohibits assigning sums already due or to become due. Indeed, in some states, at common law, a clause specifically prohibiting assignment will fail. For example, the buyer and the seller agree to the sale of land and to a provision barring assignment of the rights under the contract. The buyer pays the full price, but the seller refuses to convey. The buyer then assigns to her friend the right to obtain title to the land from the seller. The latter’s objection that the contract precludes such an assignment will fall on deaf ears in some states; the assignment is effective, and the friend may sue for the title.

Future Contracts

The law distinguishes between assigning future rights under an existing contract and assigning rights that will arise from a future contract. Rights contingent on a future event can be assigned in exactly the same manner as existing rights, as long as the contingent rights are already incorporated in a contract. Ben has a long-standing deal with his neighbor, Mrs. Robinson, to keep the latter’s walk clear of snow at twenty dollars a snowfall. Ben is saving his money for a new printer, but when he is eighty dollars shy of the purchase price, he becomes impatient and cajoles a friend into loaning him the balance. In return, Ben assigns his friend the earnings from the next four snowfalls. The assignment is effective. However, a right that will arise from a future contract cannot be the subject of a present assignment.

Partial Assignments

An assignor may assign part of a contractual right, but only if the obligor can perform that part of his contractual obligation separately from the remainder of his obligation. Assignment of part of a payment due is always enforceable. However, if the obligor objects, neither the assignor nor the assignee may sue him unless both are party to the suit. Mrs. Robinson owes Ben one hundred dollars. Ben assigns fifty dollars of that sum to his friend. Mrs. Robinson is perplexed by this assignment and refuses to pay until the situation is explained to her satisfaction. The friend brings suit against Mrs. Robinson. The court cannot hear the case unless Ben is also a party to the suit. This ensures all parties to the dispute are present at once and avoids multiple lawsuits.

Successive Assignments

It may happen that an assignor assigns the same interest twice (see Figure 14.2 "Successive Assignments" ). With certain exceptions, the first assignee takes precedence over any subsequent assignee. One obvious exception is when the first assignment is ineffective or revocable. A subsequent assignment has the effect of revoking a prior assignment that is ineffective or revocable. Another exception: if in good faith the subsequent assignee gives consideration for the assignment and has no knowledge of the prior assignment, he takes precedence whenever he obtains payment from, performance from, or a judgment against the obligor, or whenever he receives some tangible evidence from the assignor that the right has been assigned (e.g., a bank deposit book or an insurance policy).

Some states follow the different English rule: the first assignee to give notice to the obligor has priority, regardless of the order in which the assignments were made. Furthermore, if the assignment falls within the filing requirements of UCC Article 9 (see Chapter 33 "Secured Transactions and Suretyship" ), the first assignee to file will prevail.

Assignor’s Warranties

An assignor has legal responsibilities in making assignments. He cannot blithely assign the same interests pell-mell and escape liability. Unless the contract explicitly states to the contrary, a person who assigns a right for value makes certain assignor’s warranties to the assignee: that he will not upset the assignment, that he has the right to make it, and that there are no defenses that will defeat it. However, the assignor does not guarantee payment; assignment does not by itself amount to a warranty that the obligor is solvent or will perform as agreed in the original contract. Mrs. Robinson owes Ben fifty dollars. Ben assigns this sum to his friend. Before the friend collects, Ben releases Mrs. Robinson from her obligation. The friend may sue Ben for the fifty dollars. Or again, if Ben represents to his friend that Mrs. Robinson owes him (Ben) fifty dollars and assigns his friend that amount, but in fact Mrs. Robinson does not owe Ben that much, then Ben has breached his assignor’s warranty. The assignor’s warranties may be express or implied.

When the assignor makes the assignment, that person makes certain warranties, express or implied, to the assignee, basically to the effect that the assignment is good and the assignor knows of no reason why the assignee will not get performance from the obligor.

• If Able makes a valid assignment to Baker of his contract to receive monthly rental payments from Tenant, how is Baker’s right different from what Able’s was?
• Able made a valid assignment to Baker of his contract to receive monthly purchase payments from Carr, who bought an automobile from Able. The car had a 180-day warranty, but the car malfunctioned within that time. Able had quit the auto business entirely. May Carr withhold payments from Baker to offset the cost of needed repairs?

Validity of a Contract Assignment

  What Is a Contract?

A contract is a legally binding arrangement between two or more parties. A contract supplies particulars of what the parties agree to perform or exchange. A contract may be in written or oral form. In most cases, to be legally binding, a contract must be in writing and signed by all parties concerned.

Courts typically require three things for a contract to be enforceable:

• Mutual assent, or agreement to the contract terms;
• A valid offer and acceptance; and
• Consideration.

Contracts are deemed the foundation of the business world. They may be easy or very complicated. Examples of contracts include employment contracts, real estate purchase agreements, and insurance arrangements.

Contracts must be entered into by all parties freely. All parties signing the contract must do so of their own free will and not under duress . Contracts can be used whenever parties want to document an agreement to ensure all parties’ rights are covered.

Drafting a contract refers to writing the terms and details of a contract to specify and summarize the legal responsibilities of all parties to the contract. This permits all parties to the contract to understand their duties and legal obligations to one another clearly.

Anyone can draft a contract, but it would be in the best interest of all parties involved to have an attorney draft a contract, particularly if it is intricate or complicated. For instance, a real estate agreement often involves multiple aspects, multiple parties, and intricate land descriptions. To ensure your sale or purchase, financial investment, and rights are shielded, having an attorney draft this type of agreement would be preferable.

A contract will also deliver sections outlining whether or not it may be canceled and how to revoke it. The agreement will also outline the results if a party breaches the contract terms. A well-written contract will contain explicit definitions of what comprises a breach of the agreement so all parties can support their responsibilities.

What Are the Elements of a Legally Binding Contract?

What is a contract assignment, when is a contract assignment valid, are there any limitations on contract assignments, what does a contract lawyer do, do i need a lawyer for help with a contract assignment.

To be legally binding, a contract is required to include certain elements. Some contracts must be in writing to be valid, such as contracts for money over $500.00. A contract must be created for a lawful purpose. For instance, an individual cannot contract to perpetrate a crime. It is essential to be familiar with the requirements of a valid contract.

A valid contract must include:

• An acceptance of the offer;
• A promise to perform;
• A valuable consideration ;
• A date, a time window, or an event when the performance must be satisfied;
• Terms and conditions of the performance; and
• Performance.

The offer and acceptance segments of a contract are also known as the “meeting of the minds” or mutual agreement of the parties. All parties’ signing of the contract is often used to prove that agreement. In some circumstances, offers may have an expiration period, where the offer is open for a reasonable time. Some offers may not have a time limitation. Offers can be withdrawn until the time of acceptance.

Acceptance happens when the parties agree to the terms of the offer. If a modification is made to the offer terms, it would be deemed a counteroffer. Different states have various regulations in this area of contracts, so it is essential to review local laws.

For a contract to be proper, consideration must be supplied. When both parties agree to provide something of value in exchange for a benefit, consideration ensues. For instance, consideration must be something of value and can include money, a car, or manual labor.

For a contract to be proper, all parties must be legally competent . Some people cannot enter into contracts, such as minors or the mentally impaired. A party must be of sound mind and not under the influence of drugs or alcohol at contracting. All parties to a contract must be free from coercion at contracting. Contracts will be proclaimed void if there is a mistake, coercion, or deception by one or more parties.

In a contracts setting, an “assignment” refers to transferring benefits or rights granted by the contract terms from the receiving party to a different party. Therefore, contract assignments bring an additional party to the existent contract parties.

An illustration of this is where a contractor assigns their right to payments to another party. The other party would then be entitled to fees for the contractor’s work. This is different from a contract delegation , which transmits obligations rather than rights to another party. Assignment usually ensues because it involves some potential for profit for the party making the assignment.

Contract rights and benefits can lawfully be assigned so long as no prior agreement prohibits an assignment. All required is for the assigning party (the assignor) to agree with the assignee (the third party recipient) that they will be transmitting their rights to them. Interior Design Presentation Techniques & Skills

As an interior designer, creating a stunning presentation can be the difference between you winning a job or it going to someone else. But you might ask yourself “Isn’t it all about the end-result and not impressive artistic skills?” In any design field, first impressions count for everything. In lieu of a physical representation of your ideas, you’ll need strong visual presentation skills to convince your client or interviewer that you’re the right person for the job. This guide can help those already out there pitching for work as well as those of you who are just starting out. Applying these tips to your portfolio, as well as to client presentations will help you to stand out from the crowd from the off.

With all these benefits, it’s no wonder that designers are flocking to add these tools to their skillset. There are a wide variety of visual communication and presentation techniques for interior designers. Here, we’ve chosen three key skills and tools to use for the concept development and planning stages of the interior design process.

Stage 1 – Sketch for Initial Concept

So you’ve just signed on a new client! You’ve met with them, taken some photos and dimensions of the living room they want designed, and if needed, you have your survey plan ready. You’ve already discussed conceptual options, what trends and colours they prefer, and gone over examples of designs they like. Your client is now waiting for an initial concept from you. What do you do?

You’re excited to start working on your design, but it’s important to first ask yourself: what level of detail in the design is required at this stage? Your focus here should be on communicating a general direction for the plan, and using that to initiate feedback and more detailed discussions.

One of the best ways for you to quickly express an initial idea is to use the age-old reliable technique of hand drawing. A hand-drawn sketch will take you minutes to do. Not all interior design presentations have to be perfect. It’s allowed to look a little messy, and proportions and accuracy don’t need to be spot on. The bare bones are there to build on, but it hasn’t fully taken an exact shape yet.

At this point, you will have a rough idea of your floor-plan, and the amount and type of furniture that fits the space, but haven’t yet defined the exact items and their measurements. The loose style of the sketch reflects the fluidity of the design at this early stage.

The three types of sketches you can use are:

• Floor-plans to give an idea of space distribution, zones and traffic flow
• Perspective drawings to show specific zones
• Elevations to show specific walls and furniture in that view.

What sophisticated tools will you need for this? Mainly, the humble pencil… as well as an eraser, good quality art paper, a pen to finish off the sketch with. And if you want to add colour at this stage, then either colouring pencils, watercolours, or pastels.  You can also go the digital route and use tablets or smart phones with sketching features that make it really easy to add colour and make changes.

As a designer, you’re not required to show off exceptional artistry, but it is recommended that you develop good skills in sketching and perspective drawing. The better you sketch, the clearer you’re able to communicate your ideas. This creates a more professional impression as well as a more impactful interior design presentation that you can share with your client.

If you’re lucky, your client will approve the idea right away. But if you find that your design direction is off-track, then it’s back to the drawing-board for a revised concept. If your client agrees with your concept but wants minor changes, you can either send a revised sketch, or the same draft can be signed off, with notes added on the amendments.  

Stage 2 – Line Drawings for Layouts & Materials

Now’s it’s time to fine-tune! The basic concept you’ve presented needs to become more accurate, and your measurements need double-checking. You’re also starting to identify specific options for furniture and get their measurements. 

Creating accurate floor-plans at this stage will give you a clear idea whether you’re overloading your space with pieces or still have plenty of room left. Along with these, you’ll also create detailed elevations showing the different heights and openings. All of this will help determine the nature of your shopping list.

What should be your tool of choice? AutoCAD , naturally! This software has been the industry standard to draft floorplans and elevations for decades, and for good reason. Using AutoCAD will ensure that your interior design presentations look slick, professional and jump off the page.

With AutoCAD, it will take you just a few hours to create your drawings. You can also draw your furniture items as per exact dimensions, or easily add them from the program’s furniture library. This will ensure that all the furniture you’ll order or custom-make will fit in its designated areas, and help you make quick calculations for quantities of materials needed for all types of wall and floor finishes.

In our imaginary scenario, your AutoCAD 2D plans are now done and shared with the client. They reply informing you that after thinking about it, they’ll need to add a reading corner, and they’re not a big fan of the L-shaped sofa. No problem! Because you have a digital file that can be easily edited. It takes minutes to make the changes and send the revised drawings, which get approved this time around. Imagine this using hand-drawn sketches which need to be done from scratch each time a change in made?

To use AutoCAD, you’ll need to subscribe to a software license and install the software on your computer. AutoCAD is free for students studying with the NDA. There are plenty of video tutorials on the dedicated AutoCAD website as well as on YouTube. Or you could sign up for a short online course with a provider like Udemy to master these skills quicker.

Stage 3 – 3D Models to Illustrate Zones, Furniture & Accessories

You’re now progressing fast with the design development. This is one of the best bits of putting together an interior design presentation for a client. You get to go shopping for everything from flooring, paint, wallpaper and fabrics, curtains, cushions, and furniture pieces all on someone else’s budget!

Because there are many decisions that will be based on this stage, your client will now want a clear idea of the exact finishes you’ve chosen and how they go together. It’s critical that you present this stage with confidence and clarity.

What’s the best way to show all these different finishes and styling choices? You’ll need to make sure that you create a realistic feeling of the layout and different zones as well as represent your colour, texture and furniture choices with accuracy and to the best of your ability. This is the big one!

SketchUp Pro is the most popular and easiest way to achieve a professional presentation which shows your scheme in its best light. This 3D modeling software not only helps clients visualize the finished design, but it’s also invaluable to help designers audit their concepts before final decisions are made.

You can create a 3D model for the project by inputting your AutoCAD drawings and incorporating all of your selections. When you see your scheme in 3D, say you find that the walls look too dark and the flooring doesn’t quite work. SketchUp will enable you to mockup different ideas and test different materials so that you can either present the choices to your client or work out which fits before presenting.

But now that your client has a clearer idea of what the space will feel like, they ask if it’s possible to add a custom-made piece of furniture as a semi partition. So it’s back to SketchUp again, where you easily calculate the space you have and digitally design a bookcase to fit. Easy peasy!

As with AutoCAD, you’ll need to subscribe to SketchUp Pro and download the software on your computer. There is a web-only version that’s free, but it’s not recommended if you want to use the program for interior design projects as it’s just too limited in functionality. Stage 4 – Animated Walkthrough for Final Sign-off

So what’s next? You’ve done all of your plans; your interior design presentation is complete, and your client has made all the changes they want. Surely now you just need to make the concepts into reality? Wrong. Changing things past this point will cause serious issues for you and your suppliers so it’s best to make sure that your client is 100% happy and can visualize the entire scheme and how they will live in the space.

Using SketchUp again, you can create a few simulation scenes to help your client visualize each zone as well as the full space. When you finally meet with your client with the full and final presentation, they will be able to walk through each room or area and fully immerse themselves in the room of their dreams. Text description provided by the architects. The new Moscow office of telecommunications company Orange Business Services is located on two floors of “Mercury” tower of business center "Moscow city". The total area of the interior is 5,300 sq. m.

The interior project was implemented by Pridex Group Company, which combined the functions of General designer and General contractor performing the architectural and engineering design, as well as the complex of engineering works. The interior design was developed by T+T Architects bureau. 

Two reference points: customer's logo, the orange square, and accent elements in the form of circles became the basis for the architectural concept. 

The principle of an open workspace is popular all over the world. However, here the customer has built a distinct functional process in which the tasks go through a kind of "assembly line" of departments and specialists. The final placement of the departments follows this scheme.

The office space is divided into working areas and points of informal communication evenly spread over the entire space of the floors. At these points architects set the accents based on the form of circle in a particular embodiment. Workspaces are made contrastly – in the orthogonal forms and monochrome materials. Part of the informal communication points were integrated in the center of some departments showing the inextricable workflow and the process of discussion.

Materials with high acoustic comfort were used for the productive work of 500 employees. Solutions with mobile partitions in meeting rooms made the space for negotiations flexible and scalable.

"The new office for Orange Company has become for us a serious challenge. Complicated architecture of the building and a number of customer conditions demanded high professionalism of the team. Due to the selected solutions and coordinated work, we managed to implement such an ambitious project in the shortest possible time", - says Sergey Kudryavtsev, managing partner of Pridex Group Company.

"Great attention was paid to the corporate standards. “Orange” provided us with the detailed brand book with a lot of restrictions and recommendations. During the implementation we managed to create a unique solution without breaking the basic corporate strategy", - says Polina Voevodina, the main architect of the project, the T+T Architects Bureau.

"We thank the Pridex Company for the fast and high quality implementation of this complex project. Everything is done in accordance with the requirements of the Orange brand style. New office came out comfortable and functional, and most importantly - helped to raise the productivity of our employees interaction. It will definitely impact on improving the quality of service to our clients", - commented Olga Nekrasova, Director of commercial real estate and facilities management at Orange Business Services.

Product Description: As far as the main point of the concept was minimalistic and neat interior, one of the principal materials was the white color itself. However, we paid high attention to the public spaces: circular reinforced concrete staircase, lounge area near it, coffee points and kitchen, informal meeting areas, reception.

Oppositely to the white and really simple open space areas, there are accent walls with micro-cement decorative coating (Baldini) or bright orange-color ceiling detail (Tikkurilla paintings). There are also some cozy suspended lamps (“Hood”, Atelje Lyktan) with red felt shades, which determine unique areas. Using different colors from Desso Airmaster carpet collection allowed us to distinguish different functional zones by determing the floor color.

E-Motion Rudder Drive, an electric engine with… the Propeller installed into the Rudder

Hanse Yachts introduces E-Motion Rudder Drive – an interesting propulsion type, with a special folding propeller….

An electric engine and a folding propeller have been installed into the rudder shaft, replacing the combination of diesel engine and sail drive. As a result, the propeller thrust is in line with the rudder position. This enables turning in the smallest circles or rotating around your own keel; it could be a perfect solution for maneuvering in narrow ports.

Making 4.5 knots with calm seas, the new Hanse 315 equipped with four lithium-ion batteries has a range of up to to 30 nautical miles – enough for all European inland waters and many coastal waters. At lower speeds, the range is significantly increased. The Rudder Drive can also be used with two batteries if a shorter range is required. The maximum speed is 6.1 knots – nearing the maximum speed of the diesel version.

The quiet Rudder Drive is also lightweight: 100 kg less than the diesel saildrive option. The Rudder Drive does not require a hole through the hull, lowering the resistance while sailing. The electric drive’s simplicity means less maintenance, as well.

Hanse 460 review: First in a new range

For some of us, sailing has always been about the functional and fundamental. We enjoy sailing for sailing’s sake. But today people want so much more from a boat and, in many respects, today’s yachts undoubtedly offer a lot more and the Hanse 460 attempts to do just that.

What you might loosely call the mainstream European builders of family cruising yachts have been following this path for some time, making each generation of designs bigger and plusher than the last. For Hanse in particular, it has been a rapid evolution from the small, basic and functional to the large and luxurious.

This latest Hanse is the first to be designed by Berret-Racoupeau. After the earliest models, which used the moulds of discontinued, slim-hulled Scandinavian designs, every Hanse has been designed by Judel/Vrolijk in what became one of boatbuilding’s most enduring and successful partnerships.

In line with modern trends, each new wave of Hanses has been higher, wider and more voluminous than the last. Founder Michael Schmidt never lost sight of the performance side, however. For all their growing girths and towering topsides, Hanse has always made boats that sail – competitively-priced, high-volume cruisers but with easy handling (self-tacking jibs were used from the early days) and better performance than many of the alternatives.

The Hanse 460 is different. Very different. The first model from a new alliance with the French designers, it promptly won the European Yacht of the Year as the best Family Cruiser for 2022. A Hanse 510 version now follows.

The big question was whether Hanse had managed to do something different while retaining the qualities that its owners had traditionally sought.

At a glance, the Hanse 460 looks sleeker and sportier than earlier models; more angular, with a reverse rake to the bow and a pronounced knuckle running to about half-way aft. In Hanse tradition there are no hard-angled chines but, in this case, a pronounced soft chine towards the stern. In plan view you see full forward sections which, combined with the broad stern, generous freeboard and ample beam, hold the promise of enormous interior volume.

At the other end, a moulded bowsprit projects the anchor clear of the stem and provides an attachment point for an outer forestay which can carry a reaching headsail. Large windows in the topsides help to break up the high freeboard.

Scale those topsides and you’re faced with an expanse of wide, flat deck and coachroof. Moulded bulwarks edge the side decks to help keep feet where they belong should you venture forward when the boat’s heeled. Otherwise what stands out is the uncluttered appearance – lines are led aft beneath separate mouldings – and the plethora of deck hatches hinged every which way, including one that opens to reveal a large bow locker.

There was certainly nothing to complain about in the performance and handling department. We slipped along very nicely on a flat sea in 12-14 knots of wind, clocking around 7.5 knots with the apparent wind at just under 30°, and tacking through around 80° by the compass.

Enjoyable sailing

Weather helm was slight and the load on the wheels increased relatively little if I tried bearing away with the sheets pinned in, the single rudder providing plenty of grip. Provoked in the opposite direction, she coped well when pinched mercilessly and also when thrown into tight spins, only stalling briefly.

At least in the flat water and modest breeze we encountered, the cockpit worked well. In any wind and seaway you would be pleased to have the optional second table to port as a bracing point. At the helm stations you have a comfortable perch outboard of the wheel or, for energetic downwind sailing when you might need both hands, behind it. The Jefa linkage is light and direct, giving a good feel from the rudder. On the starboard side you can wind down the bifurcated backstay when extra headstay tension is needed.

Today’s cockpits are no longer just places from where you control the boat. Controlling the boat in itself is so much easier anyway, especially if – as most owners of the Hanse 460 will – you upgrade to electric winches, electric in-mast reefing and electric furling for the genoa on the outer forestay.

Other push-button options are for the hinge-down bathing platform and the cockpit tables (either side or both), which can be lowered to create large lounging areas. Alternatively there are fixed tables, as we had on the port side. A wet-bar can be added between the helm seats. It’s all part of making the cockpit a multi-function space in which every part can serve a variety of purposes. Cockpit stowage is in the form of a half-depth locker each side and – a first for Hanse – a dedicated liferaft locker right aft to starboard. With the electric-lowering option for the starboard table comes an extra moulded seat pod, which provides readily-accessible shallow stowage forward of the starboard helm and would be good to have for that reason alone.

Moving about the deck and cockpit, and from one to the other, is easy in good weather. The wide open spaces let you simply stroll around – or lounge if you’re so inclined. Then again, they tend to present more of a challenge when a boat’s bouncing and heeling.

Lifestyle choices

Externally, the hull lines clearly differentiate the 460 from her earlier stablemates, but down below it’s a world apart. It’s certainly a more classy finish than we’ve seen before from Hanse; restrained in tone and a level above what we have become used to. Berret-Racoupeau is one of relatively few yacht design studios to have its own interior-design division.

A host of interior layouts is available, from three to five cabins, up to four showers and from six to 10 berths. About the only constant is the presence of twin double cabins in the stern. Otherwise you can have different arrangements in the bow (cabins and heads) and amidships with a long or short linear galley and a bunk cabin or utility room to starboard where our boat had a chart table and heads compartment.

Details include backrests that hinge down in the saloon to provide trays and drinks-holders. You can press a button to lower the table, press another to pop up the TV from its central pod, and settle in for the evening.

Down here it’s all about sight-lines, integrating the different areas so no one feels left out, and ensuring that, as in the cockpit, every part of the layout performs multiple functions. In practice it creates a thoroughly pleasant and remarkably light environment.

Sometimes you come across a boat that makes you realise not only that yacht design has changed irrevocably, but also why it has changed and why it’s not going back. The Hanse 460 is unquestionably such a boat. How the crew lives aboard and moves around, both above and below decks, has clearly been thought about in the context of modern lifestyles. And this boat exudes style. If you like the fundamental design, you will be able to tailor many of the options and details to suit your tastes. A yacht like this is unlikely to slice to windward in heavy weather as comfortably as, say, a first-generation Swan 46, but most people aren’t really interested in that these days. I suspect the new Hanse will prove to be a pretty quick and competent all-rounder nonetheless. Simple sailing? The technology is not remotely simple any more. But with the Hanse 460, the sailing itself is simple and can still be a lot of fun.

Technology cooperation for new sailing yacht drive

Rudder Drive, the new electric propulsion system for sailing yachts developed by Torqeedo together with the large-scale boat builder Hanse Yachts and rudder manufacturer Jefa, combines outstanding maneuverability and minimal weight with a powerful emission-free motor.

The core of this innovative concept is the proven and specially adapted Torqeedo Cruise 4.0 with folding propeller, designed in to the rudder blade itself. The streamlined system replaces the combustion inboard or saildrive and removes the need for a separate thruster on the new sailing yacht Hanse 315 e-motion rudder drive, which debuts at the end of October.

Outstanding maneuverability

Due to the unique rudder placement of the 4 kW (8 horsepower equivalent) Torqeedo electric motor, the motor can apply efficient, directional thrust. The Jefa rudder blade’s range of motion was extended to a total of 100 degrees. Demanding maneuvers can now be accomplished without a separate thruster. While motoring, the yacht can spin on its own axis – both forward and in reverse. While docking, the stern can easily be maneuvered into the proper position. This is highly useful in windy conditions or in narrow slips.

With integrated Torqeedo fast chargers, the emission-free version of the Hanse 315 is fully charged in just three hours. The batteries can be recharged at the dock or during sailing when the Rudder Drive’s folding propeller is used to generate power. Nominee Spotlight: Hanse 510

The Berret-Racoupeau-designed Hanse 460 turned heads as a 2022 Boat of the Year nominee with a fresh take on comfort and volume but with an eye better sailing performance. The second model in the new range designed by the Berret-Racoupeau team, the Hanse 510 is set to make its US premiere at the 2023 Annapolis Sailboat Show—again as a Boat of the Year contender. From what our editors saw at the model’s recent showing in Cannes, the 510 is expected to be a formidable opponent in its category during CW ’s Boat of the Year judging.

As for dockside demeanor, this new range’s calling card appears to be a marked chine on the bow and an inverted bow to optimize sailing performance. According to the designers, attention was also paid to refining the hull shape to maximize interior space. The result is an easy-on-the-eyes 51-footer that values smooth sailing and fast, comfortable cruising.

According to the builder, the Hanse 510 offers unrivalled volume in the 50-foot class, courtesy of an optimized hull design. Chines at the bow and aft further allow for a slim waterline, ensuring prime performance and easy sailing.

The 510 is equipped with a large, practical dinghy garage, capable of holding an inflated dinghy of up to 8.8 feet; and the optional, newly developed Hanse Smart Tender System makes launching that dinghy as simple as “driving a car out of the garage.” Convenience and style dominate the interior. Even the crew cabin gets in on the volume action, as it’s much more than the typical (read: small) crew sleeping space—it is a room worthy of staying a while. The options list is lengthy, and the boat can be highly customized to meet owners’ needs.

“Expectations were high after the outstandingly successful Hanse 460, which has been awarded European Yacht of the Year,” says Hanjo Runde, CEO of HanseYachts. “The new Hanse 510 is the logical and consistent further development of the new concept. With her impressive volume, tremendously dynamic lines and countless options, she is redefining the 50-foot class. It is an easy to sail and enormously spacious private retreat.” 

The key talking points of the 510 are numerous. A hydrodynamic design with a slender waterline promotes better hull speed. Chines fore and aft allow for a wider hull and more interior space. The reverse, wave-piercing bow makes the yacht pitch less in strong winds, while the pronounced bow chines keep the foredeck as dry as possible. On deck, the strategically placed helm position promotes total control of the Hanse 510 in any situation, with all navigation and performance information easily accessible, as well as all lines and even the electric winches on the port side. An optional hardtop shades the entire cockpit including the steering positions, and it blends seamlessly with the boat’s silhouette. It is also available in several colors and accommodates special lighting and solar panels. A fixed windscreen is another option. 

The novel dinghy garage is capable of holding a dinghy of up to 8.8 ft without having to deflate it. Combined with the optional automatic comfort stairs and the newly developed Hanse Smart Tender System, a single crew member can safely and comfortably deploy the dinghy, including engine, in minutes.

Another novelty on the Hanse 510 is the easy-to-open life raft storage space in the cockpit. Situated just in front of the companionway, it’s easily accessible and has space for standard 8-person life raft containers. An optional wet bar with grill and sink is hinged at the stern so as not to absorb precious cockpit space. 

The boat comes rigged with a self-tacking jib, and all lines run back to the cockpit for simple sail handling of the 710 sq. ft. mainsail and various headsails. The jib is 570 sq. ft. and the reacher measures 1,011 sq. ft., set up using a Solent-style rig on the custom bowsprit. Air draft of the deck-stepped mast is just over 77 feet above the waterline. Optional electric furling systems and winches make light work of handling halyards and sheets for the optimum in performance, short-handed sailing. The standard boat comes with a single, 80 hp saildrive, although an upgraded, optional 110 hp diesel is also available.

Within the interior, 14 well positioned opening hatches and eight opening windows and portholes permit maximum light and ventilation below deck. A long list of layout options are said to be available for the interior arrangement, from an “owner’s yacht” with a best-in-class sized master cabin, to a “charter yacht” with 10 berths, three bathrooms and an additional skipper cabin. The galley can be fully adapted to the owner’s needs as well: In addition to various refrigerator and freezer options, there is room for a wine cooler, dishwasher and a three-burner gas cooker plus an oven in the longitudinal pantry, which can be customized with a vast choice of colors and materials. Another option is a fully equipped navigation area with a forward-facing seat and a large salon table. The extensive options list, ranging from a washing machine in the utility room to flatscreens in the master cabin and salon, is crowned by the Flagship Package, which includes highest-end fabrics and materials, not to mention a “hidden” bar behind the folding backrest in the salon.

At its core, the Hanse 510 emphasizes a roomy cockpit, large but manageable sail plan, and overall performance that is easily managed by a couple, but perhaps what really sets the Hanse 510 apart from other sailboats in its class is the limitless level of customization the builder is willing to offer. The Hanse 510 also comes with a CE rating of A-12, so it is well suited for those who want to venture longer distances.

The 82-foot eWolf expects to eliminate 3,100 metric tons of carbon dioxide

The nation’s first all-electric tug boat has docked at the Port of San Diego and expects to begin emissions-free operations in about a month.

Operated by Crowley Maritime Corporation , the 82-foot eWolf will escort ships entering and leaving the Tenth Avenue Marine Terminal using electric power instead of diesel fuel, helping slash greenhouse gas emissions at the port and its neighbors in Barrio Logan and National City.

“This is a big deal,” said port chairman Frank Urtasun at a news conference Monday. “This is new technology.”

Capable of speeds of up to 12 knots, the eWolf is powered by a 6.2 megawatt-hour main propulsion battery and two electric drives. The tug has thrust — also known as bollard pull in the parlance of the shipping industry — of 76.8 short tons, which is more powerful than the diesel-powered counterparts at the port.

Constructed in Alabama, the eWolf is equipped with two small generators for emergency use that allow the boat to travel longer distances at a reduced speed.

“Like an electric car, you step on the gas and it jumps,” said Paul Manzi, vice president of Crowley Shipping, based in Jacksonville, Fla. “All of the attributes that you have with an electric motor operation in a car or in an electric truck, you see here in the (eWolf) at massive scale. And it’s extremely quiet so when it pulls away from the dock you literally won’t hear any noise.”

The tug boat’s electricity will come from a charging station that is part of a microgrid facility equipped with two energy storage containers. Battery modules in each container have storage capacity of nearly 1.5 megawatt-hours.

Interconnected with the help of San Diego Gas & Electric, the charging station at the port is designed to allow the vessel to recharge quickly and reduce peak loads on the electric grid.

Operators plan to charge the eWolf overnight so it can perform its chores during daytime hours.

“This technology has individually been around for a while, but it hasn’t necessarily been integrated and optimized to all work together — and that’s kind of our role,” said Bruce Strupp, vice president at ABB Marine & Ports , the company that designed the boat’s propulsion system. “Some of the technology is our technology, some of it’s third-party technology, but we integrate it all together.”

The electric tug boat is expected to begin commercial operations at the port in mid- to late-April, depending on the completion of the charging station.

Officials at Crowley did not release the eWolf’s price tag Monday, saying only that it cost about twice as much as a conventional diesel-powered tug boat of comparable size.

But, Manzi said, the company expects the eWolf’s maintenance and operating costs will be “dramatically lower” than what’s spent on a diesel-powered tug boat because the electric model has fewer moving parts.

The entire project — the vessel as well as the charging station — received four grants that added up to $13.67 million, with two grants of $10.9 million from the San Diego Air Pollution Control District, one grant of just over $2 million from the U.S. Environmental Protection Agency and $750,000 from the federal government’s Maritime Administration.

In 2020, Gov. Gavin Newsom signed an executive order that directed state agencies to transition off-road vehicles — including tug boats — and equipment to 100 percent zero emissions by 2035.

By replacing one of the port’s diesel-powered tugs, the eWolf is expected to eliminate the consumption of about 35,000 gallons of diesel fuel per year. In its first 10 years of use, the electric tug boat is expected to reduce about 3,100 metric tons of carbon dioxide from the port and its surrounding areas such as Barrio Logan and National City.

“We’re trying to be good neighbors and trying to be able to help to reduce emissions here to help the electrification movement,” Urtasun said, adding that the port has spent about $130 million on various electrification projects.

Last year, the Port of San Diego became the first in North America to install a pair of all-electric cranes to load and off-load heavy cargo. Each 262 feet high, the cranes replaced an older crane that ran on diesel fuel. Together, the cranes expect to help the port reduce greenhouse gas emissions by 47 metric tons per year.

Boat engineering and design company EJET Electric Yacht Tenders has announced the development of its latest electric motor 9X yacht tender model.

Much like their highly acclaimed 4X tender, the upcoming 9X model sports EJET’s proprietary electric motor and drivetrain, going in line with founder Žiga Jarc’s mission of providing sustainable transportation options for yacht owners and guests. Both models will be available in the summer, with the 9X build slated for initial testing in July.

The announcement follows EJET’s recent appearance at the Boot Düsseldorf Boat Show. Having received the International Boat Industry’s Rising Star Award, the company revealed the development of its larger 9X model with the aim of promoting environmental responsibility within the boating industry.

Designed to be lightweight and compact without sacrificing output or speed, the new tender will be powered by a 220 kWh battery and a 300 kW motor, with an option to upgrade to 340 kW, ensuring 98% efficiency and making it suitable for sports such as water skiing. The boat’s V-shaped hull has been adjusted to accommodate EJET’s custom electric powertrain and is capable of withstanding turbulent waters and inclement weather conditions. Each boat is built with standard hydraulic steering mechanisms, along with the company’s military-grade jet system, allowing for easy maneuvering, reversing, and sudden stops in both low- and high-speed scenarios.

The 9X model will also feature a digital interface, which boaters will be able to use to select different driving modes and dynamics, view real-time GPS navigation and system data, and access the smart audio Bluetooth system. Additionally, amenities such as a hydraulic bathing platform, an electric grill, an ice maker, and a refrigerator will all be available as upgrade options for all 9X tenders.

I would never say “I told you so,” but…now that Candela , the world’s leading producer of all-electric-powered hydrofoiling boats, has just closed the largest funding round in the company's history, I might be bold enough to say…”I’m not surprised.”

That’s because I’ve been closely following the development of this wonderfully smart company’s hydrofoiling boats since I test flew a P-7 near their small and efficient shop in Stockholm in 2021. So, I’m really not surprised they just raised over $25 million to expand production of their game-changing P-12 ferry. And since yacht building powerhouse Groupe Beneteau is a key partner in the largest fundraising round Candela has ever completed it appears Candela’s brand of tech-controled hydrofoiling is about to go global.

The new investment round will help to scale up production to meet demand for the recently launched Candela P-12, the world’s first electric hydrofoil ferry. The P-12 is the first fast and long-range electric ferry on the market. Its efficient hydrofoil technology cuts lifetime emissions by 97.5% compared to diesel vessels, while simultaneously allowing operators to save up to 50% in operating costs. Since it generates minimal wake, the P-12 has been granted exemptions from speed limits, as for example on its maiden route in Stockholm, where it from July will cut travel times in half compared to road transport and legacy diesel vessels.

And it’s pretty obvious Hasselskog and company are on the right track. According to some projections the market for electric vessels is expected to be worth $14.2 Billion USD in 2030.

“We’ve spent years developing the technological maturity, and now we’re fit for scaling to commercial vessels. As in any industry, the fastest-scaling company will dominate the market,” says Hasselskog.

Other backers in the round include longtime investors EQT Ventures , Ocean Zero LLC , and Kan Dela AB. The new investment brings total funding since Candela’s inception to over $75 million.

Candela’s electric ferries multiply as the startup lines up $25M in new funding

Electric boat maker Candela is approaching cruising speed with $25 million in new funding and the first commercial deployment of its new P-12 ferry in New Zealand. The company has global ambitions for its highly efficient boats and has completed and delivered dozens of them — which is a lot in this industry!

Candela has been slowly upping the size of its vessels for years, starting with the considerably smaller C-7 and C-8 (noting the length in meters) — of which, as of this week, they have now produced a total of 70. The P-12, a ferry design that can handle up to 30 passengers, made its debut late last year .

Just last week, the P-12 was given its first assignment: ferry people around New Zealand’s Lake Manapōuri , a scenic destination but also, more importantly, the site of the country’s largest hydroelectric power station. And now staff at that station can get to work via clean-running boat rather than driving, which the companies estimate will save around 240 tons of emissions per year. It’s a start, and it will help keep the lake clean and quiet.

International interest in these boats is also evident in the participation of Groupe Beneteau, a more than century-old boating company that makes thousands of vessels yearly, in the funding round. Groupe Beneteau CEO Bruno Thivoyon expressed in the press release that investing in Candela makes sense as part of the company’s “ecological transition objectives, scaling up innovative solutions for more sustainable boating.”

Many legacy boating companies are embracing electric engines and next-generation tech; I spoke with the head of another major manufacturer, Brunswick’s Dave Foulkes, at CES about it. He said that the collaborations are fruitful because the small, growing companies need the income and reach, while the larger ones need ready-to-deploy tech. Like any other industry, you have to know when to buy and when to build, and big boating companies are happy to buy — or invest.

Candela’s boats use hydrofoils with electric engines mounted on the bottom to effectively fly above the surface of the water once they get past a certain speed, vastly reducing energy consumption — historically and understandably a sticking point for electric boating. The approach does necessitate a powerful autopilot to keep it balanced, and despite their assurances, I wonder about how they’d handle log collisions, but overall the advantages seem to outweigh the drawbacks.

I drove one over the summer in Seattle (watching closely for logs, rather common in Elliott Bay) and wished they would replace the gas-chugging fast passenger ferries with P-12s. Candela isn’t the only one pursuing this market, either; Navier is also attempting to woo coastal communities with the draw of quiet, energy-efficient transit and is currently shuttling Stripe employees around the Bay Area . And while Zin Boats has been quiet for some time, they are also nailing down markets for the next version of their vessel.

The $25 million round was led, as mentioned, by Beneteau, with participation from EQT Ventures, Ocean Zero LLC, and Kan Dela AB.
