What Exactly Is Yacht Management, And Why Is It Necessary?

Those well-versed in the superyacht industry will know that owning and operating a crewed yacht over 24m is no easy task. Ever-changing administrative, technical and regulatory requirements can create a minefield of hoops to jump through, not to mention the management of the crew members living and working on your vessel. And for the busy lives of the modern yacht owner, the task is simply too much to take on alone. We teamed up with Switzerland-based yacht management company Floating Life , to learn more about the benefits of outsourcing your yacht management needs to experts in the field.

The superyacht industry is evolving at such a rapid pace, it is easy to forget how relatively young it is. Owners' guide to yacht management companies

Moving up from a yacht of less than 30m to 40m, 50m or more, increases the complexity of the yacht orders of magnitude. The owner of a large yacht likely will find he or she no longer has the time, the will, or the administrative resources to navigate a jungle of yard contracts, legal hurdles, insurance options, regulations, crew management, charter management, logistics or the myriad other details associated with building, repairing or ownership.

A yacht owner going it alone may find what once was a pleasant escape from the stress and pressures of the workaday world is now a surly beast in constant need of attention.

'As yachts increase in tonnage, so do the demands on the owner. A management company takes the day-to-day burden and responsibility of running the yacht away from the owner,' says a member of the Burgess Yachts management team. 'More importantly, [managers] are there to respond to urgent situations and emergencies around the clock, and to provide advice to the owner and crew in all areas.'

Running a yacht is a full-time job

Boats are inherently needy machines. Quality time on the water rarely comes without at least a modicum of thought for their care and feeding.

Owning a superyacht can take on characteristics of running an international business. For some, a competent corporate accountant and a talented captain may be able to manage the program, but for many, at least some level of professional shore-based yacht management can be a welcome relief.

'Administration of a yacht, managing its safety, paying suppliers, managing crew and charter agents is a full-time job,' says Barbara Jolly, yacht and aircraft manager of Abacus Trust Company Ltd. 'The larger the yacht, the more likely it is for such services to be contracted out. This will allow the captain to focus on its safe and smooth operation.'

Yacht management comes in many shapes and sizes depending on an owner's individual requirements. Owners may decide to hire a small firm or individual expert to handle one element. such as regulatory compliance, and another for charter management.

A number of firms, large and small, offer 'full lifecycle' management for every aspect of ownership, beginning with an owner's decision to build a new yacht and end with its sale.

'Our yacht management services,' says the Burgess manager, 'are tailored to each owner's specific needs and can include operations support, technical management, safety management, security management, crew administration, emergency response, insurance administration, creation of a robust offshore crew employment structure, financial management and technical consultancy.

'We also can be used as an on-call advisor for any of the owner's yachting needs.'

Other large companies offer similar menus covering a broad range of services from which owners can choose a full or partial package or take the services à la carte. Burgess says 90 per cent of its fleet is under what is termed 'full management'.

Edmiston & Company says 80 per cent of its fleet is under full management, with the remainder having contracts for some, but not all, of the services the firm offers.

'We have been asked for many other services and are always happy to support a client in any way,' says a senior manager at Edmiston. 'This has included making all necessary arrangements for three tigers to attend a party for 300 people on board a 60m yacht in a US marina.'

Management networks

If a management company does not have on-staff expertise in a specific area, it often has relationships with specialists who do.

For regulatory compliance, it may go to someone like Ken Argent of Water’s Edge Consulting Ltd., who specializes in ISM and ISPS (International Safety Management Code/International Ship and Port Facility Security Code) management and MLC (Maritime Labor Convention) compliance.

Argent’s business provides shore-based regulatory compliance services to yachts over 500GT that are engaged in trade (charter in the case of yachts) as required by the various codes, regulations and conventions.

Most broad-brush brokerage companies offer regulatory compliance services, but, says Argent, ‘Some owners prefer to deal with people who have no connection to a brokerage house.’

Other firms offer a wide range of services, but specialize in a narrower branch of management. Isle of Man-based I-Cap Marine Ltd., is an example of a larger company that focuses on a speciality slice of the management pie. I-Cap Director Stephen Brew described his company as a ‘corporate and statutory manager’.

‘A yacht manager will undertake technical management, day-to-day crew management, and day-to-day operational management of the yacht, in close co-ordination with the captain and crew,’ says Brew. ‘The corporate and statutory management of the yacht, which is what we undertake at I-Cap Marine Ltd., is in very simple terms, the management of the corporate ownership structure.

‘At the same time, we work with nearly all of the major yacht managers for yachts of all shapes and sizes. [When there is a] yacht manager involved, we tend to look after the ownership structure, accounting and VAT compliance, while the yacht managers handle all day-to-day, operational oversight of the yacht.’

Managing private yachts

By some estimates, there are more than 7,000 yachts 24m and above worldwide, but only a small percentage of their owners retain the services of a management company. Those who don’t are likely owners of private yachts that do not engage in commercial activity such as charter. So who’s coordinating all the details if not a management company?

Often captains serve as the lead management executive, hiring crew, keeping books and managing the technical aspects of the yacht. But an owner moving up in class may find the added layers of regulation and compliance strain the resources and time of his captain.

Some owners use accountants or managers within their businesses and software such as Marine CFO or Manage My Vessel to coordinate those activities in conjunction with the captain. The owner of the 85m Cakewalk, launched in the US in 2010, established a separate entity to handle the management details of his yachts.

‘We started our own management company, Yacht Logistics Inc., in 2000, after the launch of the 62m Cakewalk [the owner’s previous yacht],’ says the owner’s long-time captain, William Zinser.

‘We sent a former crew member to school to learn the safety management program required to manage our vessel. We set up our own payroll, insurance, immigration lawyer, accountant and our own safety management program,’ continues Zinser, ‘which ended up being less expensive than the alternatives. We use a shoreside engineering company and pay them as we go.

‘I initiate and oversee all of the SMS [Safety Management System] on board Cakewalk and delegate its implementation to the necessary crew to make sure it is adhered to.’

Zinser, who is a partner in Yacht Logistics, says the company now handles safety management, payroll, mail and other services for four other vessels. He thinks a management company is a good choice for novice large yacht owners.

‘A person who has never been a yacht owner before could definitely benefit from a large management company, unless he or she can put all this together himself or herself before purchasing a large yacht,’ he says.

Beware of the well-presented ‘one-stop shop’ approach, as very few companies can actually deliver this in a meaningful way.

Yacht Charter Costs Explained

A comprehensive breakdown of your charter costs and fees.

When you begin planning a luxury yacht charter it is important to be aware of what is included in the cost of booking your dream charter yacht. although a yacht will have a base charter fee, this may or may not include additional expenses such as food and fuel and this is subject to the terms and conditions within the charter contract. there are various types of charter contracts and which one applies to you will depend on where you wish to cruise., high season.

High season refers to the most popular weeks of the year for yacht charter, whether it’s the winter period in the Caribbean or the height of summer in the Mediterranean , booking in high season requires early planning, determination and a big budget. In addition, planning a yacht charter to coincide with a major event will also be reflected in the price with marine spots for elite events often booking up early. Allow plenty of time when making enquiries to ensure a star studded, well prepared arrival.

Low season typically refers to any time outside of the high season periods. Groups of families and friends looking for a relaxing luxury vacation are advised to avoid high season weeks and opt for weeks outside of this time. The busiest periods are of course reflected in the charter costs and can be up to 15 to 30 percent more expensive than typical low season periods. Chartering a few weeks either side of these busy periods can be almost exactly the same, with the weather almost unchanged in some places, with far less crowds.

This article will go into detail of the costs to be expected when planning and booking a yacht charter. From the base charter fee of a yacht, what is covered within the fee and how it may vary in addition to details of contracts and how an Advance Provisioning Allowance (APA) can be used to manage any expenses.

Base Charter Fee

The base charter fee in essence refers to the hire cost of the yacht itself, with all equipment in working order in addition to the cost of food and wages for the crew during the entirety of the charter. This is essentially all the base charter fee covers with additional expenses often applicable on top. The base charter fee will vary from one yacht to another and this may be down to any number of reasons from size and on board amenities to the charter season. For instance, the base rate of a charter yacht may increase in "high season" and reduce during the "low season". "High season" and "low season" refers to the busiest and slowest periods for yacht charters though this may appear misleading, as these peak times refer to periods of weeks as opposed to full seasons. In addition, you may find that a yacht is also more expensive during special events such as the Monaco Grand Prix, Cannes Film Festival and America's Cup. Unless you are keen to charter a yacht for a particular "high season" event, choose your dates carefully as although a "high season" rate will be more expensive than the "low season" the two can sometimes share much of the same weather conditions.

Aside from seasons and events, yachts of the same size may also differ in price and this may be down to a vast difference in on board amenities. A yacht which boasts an on board cinema or lavish water toys may have a higher base rate compared with a yacht of minimal amenities of the same size. If it is unclear as to why two yachts of the same size are vastly different in price, ask your yacht broker to explain what the differences are. Once you are clear on what the base price is and why, it is important to discover what costs will be applicable on top and this is dependent on the type of charter contract used.

The type of charter contract applicable to your charter will depend on where in the world you are cruising, as there are various terms within the industry which dictate how the payment structure is determined. For instance, a MYBA (Worldwide Yachting Association, formerly known as Mediterranean Yacht Brokers Association) contract operates under Western Mediterranean Terms (WMT) and is arguably the most commonly used, particularly with large yachts embarking on a Mediterranean yacht charter. This contract is often referred to as a "plus all expenses" contract and requires that the charterer pay for fuel, food, beverages and dockage fees as an additional expense outside of the base charter fee. Typically, guests can accumulate an additional 25% to 50% of the base charter fee though this is dependent on what is consumed. These expenses can be tracked through the use of an Advance Provisioning Allowance (APA) which we will cover in the next section.

Alternatively, smaller yachts on a Caribbean yacht charter can expect a "mostly all-inclusive" contract known as Caribbean Terms Inclusive (CTI) sometimes referred to as Standard Caribbean Terms (SCT). The Standard Caribbean Terms greatly differ from Western Mediterranean Terms, as the Caribbean terms include three meals a day in addition to four hours cruising per day which is included in the base charter fee.

In addition to the commonly used MYBA terms and Standard Caribbean Terms, there are also less frequently used terms such as Standard Eastern Mediterranean Terms (SEMT) and Greek Terms (GI). Advance Provisioning Allowance (commonly referred to as APA)

Irrespective of the charter contract it is important for guests to be aware of the Advance Provisioning Allowance (APA). The APA was designed to enable charterers to manage their expenses through a clear and trackable arrangement. An APA is a way to deposit the estimated expense amount of your charter to cover costs such as fuel, food and dockage fees. Typically, the APA accrues to approximately 25% to 30% of the base charter fee, though this does of course depend on the charter parties tastes and requirements and could be far less or far greater than this estimation. For instance, charter guests who intend to regularly dine on caviar and vintage wine can expect to pay more, whereas guests on board a sailing yacht charter can expect to save on fuel costs. Charterers can request an estimated APA amount from the yacht broker based on their on board expectations.

The APA is to be paid approximately one month prior to boarding the charter yacht and is paid directly to the Captain of the yacht. Once the APA has been paid to the captain it will then be retained as a bank account of sorts, from which the captain can make expenditures whilst keeping a record of what has been spent. At any point during the yacht charter guests can request a rundown of accounts from the captain as a way of keeping track of expenditures. The captain will request that any additional funds are paid during the charter should guests exceed the APA. It is therefore a good idea to keep an additional account with your yacht broker on shore, as should the APA become critically low at any time the yacht broker can release additional funds to the captain on the charterers command. Cash can be used if necessary though an on shore account may be deemed as hassle free to some.

It is important to remember that food and fuel for example, are charged at cost without mark up to the charterer and upon disembarking, transactions can be reviewed by the "head" charterer and Captain with any remaining funds to be paid back to the charterer.

Fuel and Dockage Fees

It is important to remember that whilst considering fuel costs, the fuel consumed when using jet-skis and tenders will also apply to the charterer. In addition, whilst docked at a marina the generators used in order to produce electricity will also use fuel. The distance travelled and speed of cruising also affects fuel costs and it is important to bear these factors in mind. Dockage fees may vary from very little to large sums and this is dependent again upon the location and whether you wish to dock during a special event such as the Monaco Grand Prix.

Although insurance costs are not directly connected to the charter costs as such, it is useful to bear in mind should you with to take out Charterers Liability Insurance or Cancellation and Curtailment cover. Value Added Tax (VAT)

European Union (EU) tax laws state VAT will apply should you disembark within their waters, for example Italian territorial waters. This may also apply to some Caribbean islands. Commercially registered vessels are usually VAT exempt though vessels which are not commercially registered will be liable for VAT for all charters within the EU.

No request is too large or detail too small on a yacht charter though it is wise to keep in mind the shipping costs should you request an expensive bottle of champagne to be transported to you whilst you are residing in a secluded bay of the Caribbean. It is important to understand the entire payment structure to ensure no unpleasant surprises arise and it is often prudent to keep an escrow account with your broker on shore in order to control charter costs without having to carry cash on board.

Management companies take all of the stress out of this process and allow the owner to get the most out of his or her boating experience.

What is Boat and Yacht Management

A yacht management company is an entity that stores and maintains the vessel for the owner. The company keeps the yacht at the marina and is on call 24 hours a day for any maintenance issues, legal problems, and virtually any situation that arises in regard to the yacht parked in the harbor. Yacht management companies can also have marinas or dry storage facilities for vessels that need to be kept out of the elements for a long period of time during the off season.

Who Needs It

Management companies appeal mostly to busy business minded people who want to own a boat or yacht, but do not have the capacity to store and keep up with the maintenance of the vessel. The people that own yachts and require the expertise of a management company are generally those that are already running their own company or have high demand jobs that take up the majority of their time. The owner can come and go with the boat as they please without worrying about the ever mounting details of yacht maintenance.

The Need for a Crew

Larger super yachts often have the need of a crew for their day to day maintenance not only when docked, but also when the owner decides to take the vessel out to sea. Provided the yacht owner does not already have a crew at the ready to assist them as they take the yacht to exotic ports throughout the world, thee management company itself can provide the crew for the owner. This can be anything from the captain to pilot the vessel all the way to deck crew and a chef. Whatever crew is needed for the job, a good yacht management company will have them available at a moment’s notice.

Specific Needs

Each owner will have specific needs for their yacht. Some owners want to handle some of the yacht maintenance requirements while others will allow the management company to maintain most of the control over all aspects of the vessel. Full management refers to the financial, technical, crew employment, security management, safety management, and operations support. These owners can simply pay for the services to the single entity as opposed to writing checks and paying bills to many different areas. Management agencies streamline the process to make yacht and boat ownership easier for the owner.

Not all yachts are meant to be chartered, but some yacht and boat owners will choose to utilize this option to gain back some of their investment. This is especially true if the yacht is not used but a few times per year. The management company can work with the owner to have specific dates set aside for their personal use and therefore make the yacht or boat unable to be chartered for that period of time. The other times throughout the year the vessel can be chartered available with the crew and captain from the management company. This option is becoming more and more popular as those that cannot or do not want to purchase a yacht for themselves, can still access the luxury accommodations by chartering.

From general maintenance (wash, wax, varnish, minor repairs) to big service items (engines and drives, generator, bottom paint, electronics) Jay Siebert has handled it all. He is a quality (and honest) person who does quality work.

If I could give 10 stars I would! We brought our boat to Florida last fall for the winter and had a few issues that needed to be resolved. Not knowing who to trust in the Palm Beach area, Siebert Yacht was recommended by Sabre and we couldn't be more pleased. Jays knowledge of boats [especially Sabres] is remarkable. When we brought the boat home in the spring it was pristine. He is a perfectionist at what he does, from the immaculate engine room to the shiny hull to the icy air conditioning his attention to detail is amazing. His response time was also unbelievable, there is not an issue that he can't resolve. Can't say enough about the Seibert Yacht Management team. Very satisfied with their level of expertise.

Yacht service: getting your sailing yacht ready for the season

A guide to luxury yacht servicing with Oyster Yachts

From water maker and sail checks to winch and engine servicing, this is our guide to yacht service and maintenance that will ensure your readiness for a great season on the water.

Maintain your yacht maintenance log

When taking delivery of their yacht, every Oyster owner receives a maintenance manual and logbook that allows them to easily track their yacht’s maintenance history. The Oyster logbook contains a weekly, monthly, bi-annual, annual, five-year and ten-year servicing checklist which ensures the timely care of the yacht.

Following these time prompts is key to maintaining a healthy and safe sailing yacht, and an updated logbook may also increase the residual value of the yacht if you decide to sell her in the future, as new buyers prioritise well-maintained boats.

We keep records of each yacht’s original plans and build logs, meaning owners can refer to the original specifications and build intentions when commissioning service and refit work.

What to expect from your service

No one understands Oysters better than we do, and our Global Service Network provide annual, seasonal and select service options based on your needs.

Annual services comprise in and out the water essential services unique to your yacht, depending on its current condition and plans for the season ahead. The team undertake work including a 100-point manufacturer check and report, safety equipment service and certifying, structure, thru hull fitting and deck fixing checks and more.

Hauling out allows for the application of new antifouling paint and servicing of the rudder, propeller, seacocks and thrusters, as well as being a good time to polish the hull and superstructure.

When visiting the Global Service Network, our  service team  will create a list of requirements, scoping everything from canvas work to winches, meaning you can set sail for the season confident in the knowledge you are ready to take on anything.

What to expect from your pre-season check and annual yacht haul-out

Annual pre-season checks and preparations for an Oyster may include:

• Sails valeted
• A visual check of your rigging or official survey of your yacht rig, if in commercial use
• Engines and generators serviced
• All systems checked over – e.g. air-conditioning, refrigeration, LPG, electrics, and electronics
• Annual safety equipment checks

When she’s lifted out of the water for an annual haul-out:

• Antifouling and polishing
• Check of the propeller, shaft and cutlass bearings
• Steering system checks
• Replacement of anodes
• Service of seacocks and thrusters

One reason for the high price tag is the exceptional superyacht-caliber cabin. The interior was fabricated by the German company Metrica, a 340-year-old firm specializing in yacht and residential interiors, that brought to life designer Patrick Knowles’s vision. It’s rare to have a European company do an interior of a boat being built in the U.S. But the owner clearly wanted to establish a pedigree for the vessel that went beyond the usual sportfish interior. It shows in this boat.

Metrica literally transported a high level of fit and finish to the project by constructing the interior in Germany and then transferring it piece by piece to Michael Rybovich & Sons Custom Boat Works in Palm Beach Gardens.

There are many details that simply do not exist on other sportfishing vessels. In the salon, the dinette is upholstered in soft, blue leather with glove compartments that match the owner’s Ferrari, as well as the color scheme found in his home on Key Largo. III Amigos’ s galley is also a rarity. The owner had made his money in the food industry, thus this space was sacrosanct. Witness the full-custom, stainless-steel hood over the oven and an outsized Sub-Zero refrigerator the owner chose after the interior plans were complete. That required reframing the interior ceiling so it would fit.

This vessel was, in fact, designed for fishing voyages. The bridge is enclosed (rather than open, like most offshore fishing vessels) for the extra protection from the elements. It also becomes a second, albeit informal, salon for the crew. This boat was meant for long runs from the Keys to the Pacific side of Costa Rica, so the enclosed bridge made good sense.

With twin 2,000 hp M96L MTUs, III Amigos can top out at 41 knots (wildly fast when considering its size) and cruise comfortably at 34 knots. However, for longer runs the captain can bring the throttle down to nine knots for a range of 2,000 nautical miles—enough to get from Miami to the shores of Colombia without refueling.

This new breed of offshore vessels, alongside boats like the 90-foot Jarrett Bay Jaruco and the 97-foot Weaver 18 Reeler , has blurred the dividing line between fishing boat and megayacht. Of course, the most dramatic example is the 171-foot Special One , which launched this summer. Somewhere in the middle, III Amigos carves out its own space, a classic-looking battlewagon with the heart of a superyacht.

I can't say enough good about this dolphin cruise! Forest and Ireland were awesome. They were fun, personable, and professional. They were awesome with kids, they made everyone laugh, and they sang happy birthday to another passenger. If you are ever in the area this is definitely worth it. These two are assets to the company!!!

My husband, daughter (age 4) and I loved this cruise. Jason was awesome and made us laugh. Not only that but told us history . He took his time to ask around where everyone was from. Dolphins were showing ofThis is one of the cruises we would love to do again when we go back to the state. Bird island that we got off at was great! We found crabs and shells !

Just drove 2 hours for our booked dolphin cruise for our anniversary, and got a call saying no one else booked the cruise so they arent doing the cruise. Way to show how you feel about your customers! Now it's too late to book anything else, it's our anniversary, and your company has completely screwed up our day. I will not bother rebooking. So unprofessional and extremely disappointed. Thanks for ruining our anniversary day.

What a fun trip!! Even with the chilly wind, we had a great time! The guys were fun and interacted with everyone. This is our first time on a catamaran and we loved it and will for sure be back!! Forest, Spencer and Jason

We had a fantastic time today out with Forest and Jackson! No dolphins but we didn't care. The music and vibes were on point, jellyfish swimming by, cranes in the tall grass, and a bald eagle. Stop at Bird Island was great! I'm sure that on a hot summer day, it is just the thing to take a dip while there exploring. Our family of five had a fun time and highly recommend. Forest and Jackson have great personalities and definitely got the boat laughing and singing. Highly recommend!

Can I please give more than 5-stars??? Yes, the booth was unexpected, but we were greeted by Mr. Chip with a huge smile and laughs right from the time we checked in. The only negative is that Forrest wouldn't share his Spotify playlist with us! It was seriously the best soundtrack for this type of trip! The father/son duo was so much fun to witness and they took great care of us to ensure we had a memorable time, even going well out of their normal distance to make sure we saw dolphins and "South Miami Beach" (Way to go Mr. Chip, you got her good!) They made sure we were all safe as they spotted lightning in the distance while we were off-boarding on Bird Island for our excursion and quickly got us all back on to head back to the dock. It was a memorable trip as we couldn't out-pace the storm and the father and son duo committed to our safety (and their own) but still had so much fun with us as the rain and i'm pretty sure that was hail drenched us all! They sang loud with us (only the 4 of us knew the songs) and just made it the most memorable part of our trip to Myrtle Beach for sure! I will come back with my family to see you all again soon!

Our group had an awesome time. Both captains were great; They did a great job making it fun for both adults and children! Would definitely recommend and book again in the future.

OK, the positives first: Forrest was a terrific captain and got us out to see some dolphins. They aren't always around and you have to get lucky, and he was diligent and seized the fleeting opportunity that came up. The boat was nice and offered some shade, too, which was great. And Forrest and Jackson were friendly, easygoing guys. Forrest in particular provided a lot of good information about the area and the answers to any questions that came up. But folks should be aware: in our case this turned into a bit of a booze cruise, not the ideal family-friendly excursion. We had the bad fortune to sit near a loud group that was ordering additional libations as fast as they could drink them, and with each drink they got louder and more obnoxious. It really made the ride out and back pretty miserable at times, and I can't help but wonder what condition those folks were in to drive home after all the drinks they were served. The boat is pretty small, so there's no way for any other passengers to get away from a group like that. If you just want to kick back, have a number of drinks, listen to loud music, and go see some dolphins, this might be an ideal cruise for you. If you're a family with kids looking to commune with nature and just hear the sound of the surf and the breeze, maybe not so much.

Amazing staff, amazing and relaxing boat ride. My friends and I had a great time. The best customer service experience I've ever had in my life. Will continue to come back whenever I visit Myrtle beach again. Highly recommend!

The only thing that would have made our tour better would be to add another 2 hours onto the ride. Thank you for the fun, the hospitality and for sharing your knowledge of the area.

LOS ANGELES – Prosecutors are seeking restitution for the families of 34 people killed in a scuba dive boat fire in 2019 that was the deadliest maritime disaster in recent U.S. history.

A judge will determine the amount on Thursday during a hearing in federal court in Los Angeles. The proceeding comes nearly five years after the Sept. 2, 2019, tragedy off the central California coast, which prompted changes to maritime regulations, congressional reform and several ongoing civil lawsuits.

The captain of the Conception, Jerry Boylan, was convicted last year of one count of misconduct or neglect of ship officer following a 10-day trial in federal court in downtown Los Angeles. The charge is a pre-Civil War statute colloquially known as seaman’s manslaughter that was designed to hold steamboat captains and crew responsible for maritime disasters.

He was sentenced to four years in prison and three years of supervised release. He is out on bond and must report to the Bureau of Prisons by Aug. 8. His appeal is ongoing.

The Conception was anchored off Santa Cruz Island, 25 miles (40 kilometers) south of Santa Barbara, when it caught fire before dawn on the final day of a three-day excursion, sinking less than 100 feet (30 meters) from shore.

Thirty-three passengers and a crew member perished, trapped in a bunkroom below deck. Among the dead were the deckhand, who had landed her dream job ; an environmental scientist who did research in Antarctica; a globe-trotting couple; a Singaporean data scientist; and a family of three sisters, their father and his wife.

Boylan was the first to abandon ship and jump overboard. Four crew members who joined him also survived.

Although the exact cause of the blaze remains undetermined, prosecutors blamed Boylan for failing to post the required roving night watch and never properly trained his crew in firefighting. The lack of the roving watch meant the fire was able to spread undetected across the 75-foot (23-meter) boat.

But Boylan's federal public defenders sought to pin blame on boat owner Glen Fritzler , who with his wife owns Truth Aquatics Inc., which operated the Conception and two other scuba dive boats, often around the Channel Islands.

They argued that Fritzler was responsible for failing to train the crew in firefighting and other safety measures, as well as creating a lax seafaring culture they called “the Fritzler way,” in which no captain who worked for him posted a roving watch.

The Fritzlers have not spoken publicly about the tragedy since an interview with a local TV station a few days after the fire. Their attorneys have never responded to requests for comment from The Associated Press.

Three days after the fire, Truth Aquatics filed suit under a pre-Civil War provision of maritime law that allows it to limit its liability to the value of the remains of the boat, which was a total loss. The time-tested legal maneuver has been successfully employed by the owners of the Titanic and other vessels and requires the Fritzlers to show they were not at fault.

That case is pending, as well as others filed by victims’ families against the Coast Guard for what they allege was lax enforcement of the roving watch requirement.
