A few days ago, I was watching an Ed Mylett interview featuring Ryan Serhant, a highly ‎successful real estate agent in New York City. According to Ryan, a key factor in his success is ‎reaching out to 15 new people daily. This resonated with a conversation I had two months ago ‎with Rick Fingerman, a local financial planner, who shared a similar strategy. He recounted the ‎story of a very successful insurance agent who attributed his success to talking to three new ‎people seven days a week about what he did for a living. He said it didn't matter if they were at ‎the supermarket or he met them at church, the key was to talk to three new people a day.‎

The Florida Yacht Brokers Association (FYBA) was created in 1987 to unite the businesses within the yacht brokerage industry in order to promote professionalism and cooperation among its members as well as promote and maintain a high standard of conduct in yacht brokerage transactions.

The Florida Yacht Brokers Association (FYBA) was renamed the International Yacht Brokers Association (IYBA) in 2016 to better reflect its membership.

IYBA membership is comprised of more than 1800 individual members representing over 400 prominent businesses and firms located across the country and around the world. IYBA members are professional who work in various segments of the marine industry such as brokerage, charter, maritime law, marine finance and insurance, news publications, documentation, registration and more.

IYBA members devote themselves to maintaining a high standard of business conduct and professionalism while transacting business within the marine industry. Every member is required to abide by a code of ethics to protect the public against fraud, misrepresentation, or unethical practices in the yacht brokerage profession. Each member is to endeavour to eliminate any practices that could be damaging to the public or the dignity and integrity of the yacht brokerage profession.

EDUCATION The IYBA provides educational seminars and services to its members to strengthen the ability of our industry to remain abreast of legal, technical, and environmental issues that affect the marine community throughout the state.

PROFESSIONALISM Along with professional oversight, IYBA joined the Yacht Brokers Association of America (YBAA) in funding and establishing the Certified Professional Yacht Broker (CPYB) program. For a complete list of our Code of Ethics we invite you to go to our By-Laws, Article XV.

NETWORKING The IYBA provides many opportunities to network through our social and professional events and seminars. Our publication, COMPASS, is an informative magazine updating our members 8 times a year with articles on legislation and maritime law, Member News, and Bulletin Board.

MLS The member listing service (MLS) is a database established by our industry’s leading professional yacht broker associations to collect, control & provide data about vessels for sale and is exclusively for yacht sales professional use. The MLS allows yacht brokers to see one another’s listings with the goal of connecting buyers to sellers through a yacht sales professional (YSP).

YACHT & BROKERAGE SHOW The Yacht & Brokerage Show, held yearly in Miami, is owned jointly by the International Yacht Brokers Association and Yachting Promotions Inc. The show represents a significant cornerstone of achievement to the Association and the yacht brokerage community.

LEGISLATION As an advocate of one of the Sunshine State’s largest industry (the marine industry), the IYBA serves as a united voice for yacht brokers in the legislative and regulatory processes. By actively engaging with state and local legislators, the IYBA’s lobbying efforts have protected and nurtured the health of the yachting community since its inception.

They say that it will take about 100,000 articles to cover the full scope that they have envisioned for the website. They have over 20,000 articles so far and that's doing pretty well, but it could take several years to get the rest. I also noticed that many of the Main Topic Pages and some of the article pages are still in the rough draft stage. I guess that they will fill in as they can get volunteers to work on them. But what I can't figure out is why anyone would spend the time writing informative in depth articles just to give away free to this website for publication? What's in it for them? "

Writing such articles helps establish them as knowledgeable professionals. After all, this website was originally created by a school for marine technicians and marine surveyors. The website is growing in content every day. They even had to move to a bigger, more powerful server because the website's traffic has been growing exponentially. "

This site is quickly becoming the ultimate reference resource about every aspect of boats and ships for everyone from the beginning recreational boater to the seasoned professional mariner. I use the topic pages on the right sidebar to browse around the website. It's like a Junior Woodchucks' Guidebook for Boaters. Their Members' Library of over 300 popular and obscure books and over 200 magazine back issues that can be viewed online is fabulous. The Academy's magazine is especially informative. On top of that, there is the "Ask-An-Expert program for members where you can get an expert's answer to any of your boat questions. And a whole years membership is only $25. What a deal! I really love being part of this "Everything About Boats" community and help provide thousands of helpful articles free to the public. I think that I'll sit down right now and write an article about my experiences boating with my uncle. "

Sure, it has a lot of good information for boaters, and they're adding more every day, but it will probably never be finished. Furthermore, I don't even own a boat. And I wouldn't have a boat even if someone gave me one. Boats are a waste of money and time and energy and money! They're just a hole in the water you pour money into. If you gave me a boat, I'd sell it quicker then you could say Baggywrinkle. FYBA - Florida Yacht Brokers Association

The florida yacht brokers association (fyba) was created in 1987 to unite the businesses within the yacht brokerage industry in order to promote professionalism and cooperation among its members as well as promote and maintain a high standard of conduct in yacht brokerage transactions..

FYBA membership is comprised of over 1100 individual members representing over 400 prominent businesses and firms located across the country and around the world. FYBA members are professional who work in various segments of the marine industry such as brokerage, charter, maritime law, marine finance and insurance, news publications, documentation, registration and more.

FYBA members devote themselves to maintaining a high standard of business conduct and professionalism while transacting business within the marine industry. Every member is required to abide by a code of ethics to protect the public against fraud, misrepresentation, or unethical practices in the yacht brokerage profession. Each member is to endeavour to eliminate any practices that could be damaging to the public or the dignity and integrity of the yacht brokerage profession.

FYBA is now the International Yacht Brokers Association

The Florida Yacht Brokers Association has changed its name to the International Yacht Brokers Association (IYBA), to better reflect its membership.

“When we mapped out the FYBA membership, it reinforced what we already knew, that FYBA is truly an international organization with members operating in popular yachting areas not just in Florida, but around the globe,” FYBA Executive Director Cindy Sailor stated in a press release. “Our new name, International Yacht Brokers Association, better reflects who we are — the largest and most prestigious group of professional yacht and charter brokers in the world.”

The organization was founded nearly 30 year ago and has more than 1,350 members working in more than 400 businesses. According to the group, its members are responsible for 20 percent of all international yacht sales as well as 50 percent of all U.S. domestic yacht sales and 80 percent of all yacht sales transactions in the state of Florida.

We Never Underestimate Your Dreams

Florida yacht broker association (fyba) membership.

To become a member of the Florida Yacht Broker Association (FYBA), you apply through the form at fyba.org . An applicant must work for a yacht brokerage (or possibly a yacht brokerage affiliated company). The applicant may be the owner, a salesman, or an unlicensed employee of the brokerage such as a secretary or webmaster.

Additionally, the applicant needs 2 sponsors. For the owner i.e. broker of record to become a member, his or her sponsors must be FYBA active professional professional associate member. Finally, the support membership allows the sponsors to be either brokers or salespeople. His or her employing broker and a salesperson or two at the same brokerage could sponsor a support applicant. The support applicant becomes a support member.

The annual dues for the broker, salesman, and support memberships are, respectively, $200, $75, and $25 as of the print date of this article. There is no application fee.

All applicants must also provide two additional references from previous employers or business associates. These references attest to the character of the prospective member.

All Jordan Yachts employees are FYBA members in good standing. If you’re looking to become a FYBA member, contact us, and we’d love to get to know you. See us at the FYBA East Coast 3rd Thursday open houses. The cover charge is $20 for prospective members while free for members.

Florida Yacht Brokers Association: The Cornerstones of the FYBA

Founded in 1987, the Florida Yacht Brokers Association (FYBA) was established to unite those yachting professionals engaged in the practice of buying and selling yachts in the state of Florida.

Today, the FYBA is a statewide association which has grown into one of the world’s largest organizations of yacht brokers with over 1,100 members, including associations and affiliates of the marine industry at large.

The following cornerstones of the FYBA represent a few of the critical missions the associations aims to accomplish:

Education: The Florida Yacht Brokers Association provides educational seminars and services to its members to strengthen the ability of our industry to remain abreast of legal, technical, and environmental issues that affect the marine community throughout the state.

Legislation: As an advocate of one of the Sunshine State’s largest industry (the marine industry), the Florida Yacht Brokers Association serves as a united voice for yacht brokers in the legislative and regulatory processes. By actively engaging with state and local legislators, the FYBA’s lobbying efforts have protected and nurtured the health of the yachting community since its inception.

Bylaws: Along with professional oversight, FYBA joined the Yacht Brokers Association of America (YBAA) in funding and establishing the Certified Professional Yacht Broker (CPYB) program. For a complete list of our Code of Ethics we invite you to go to the FYBA By-Laws, Article XV.

Networking: The Florida Yacht Brokers Association provides many opportunities to network through our social and professional events and seminars. Our publication, COMPASS, is an informative magazine updating our members 8 times a year with articles on legislation and maritime law, Member News, and Bulletin Board.

FYBA BROKERAGE FORMS UPDATE

The FYBA Purchase and Sale Agreement (PSA) and Listing Agreement forms were recently updated. The key changes to the forms are described below, including a comparison of the new provisions to the old provisions and the reasoning for each change. Most of the changes are not intended to vary the intent of the agreements. Their purpose is to clarify and deal with potential misinterpretations by “heading them off at the pass.” 

There also were some very important changes to the PSA designed to strengthen its integrity. The first deals with the situation in which a buyer signs a PSA but never “antes up” the required deposit. Previously, a buyer could generally just “walk away scot-free” but no longer. A provision also was added so that, in the event of litigation, the prevailing party will get its attorney’s fees whereas previously each party to litigation paid its own freight. 

Other important changes to the Listing Agreement deal with what happens when a person to whom a broker showed a yacht purchases it after the original listing has expired. In addition, the standard length of a listing was increased to one year.

PSA Updates

New Provision: Whether or not the buyer inspects the yacht, he rejects it if he fails to provide timely written notice of acceptance: Although the PSA already provided in paragraph 3 that a buyer rejects the vessel if he doesn’t accept it in writing, it is now absolutely clear that no inspection is required in order for a rejection to occur. The change was made to deal with the potential argument that in order to be able to reject the vessel, a buyer had to inspect it – and if the buyer didn’t inspect, he waived his right to reject.

New Provision: The seller is solely responsible for the broker’s commission: Although this provision is already in paragraph 5 of the Listing Agreement (and is the law even without an agreement), it was added to the PSA because buyers ask the question often enough. Now, a broker can point to paragraph 5 of the PSA and reassure the buyer, since buyers aren’t parties to and don’t see the Listing Agreement. 

New Provision: If the vessel is damaged and repaired after acceptance, the buyer now has an explicit right to inspect those repairs: If the vessel is damaged after acceptance, the seller is obligated in paragraph 7 of the PSA to make repairs if they can be made for less than 5 percent of the purchase price and require fewer than 30 days to complete. Previously the PSA did not state the obvious, that a buyer had a right to inspect those repairs (and make an issue out of it if the repairs were not done properly). The update makes it clear that the buyer has the right to inspect such repairs. 

New Provision: The seller will retain the buyer’s deposit, notwithstanding any other term in the contract, if the buyer fails to pay the deposit when due or the closing is not consummated due to Buyer’s nonperformance: The PSA already provided in paragraph 8 that the seller will retain the buyer’s deposit if the buyer breaches. But what happened if the breach was not paying the deposit?  

The new language includes a hammer. The new approach is as follows: If a buyer signs a contract but doesn’t pay the deposit, he no longer can walk away by saying, “Hey, I had a right to reject by not accepting anyway.” The PSA responds to that type of buyer by saying clearly, “No siree, Bob!”

The message to a buyer is now, “If you are going to sign a contract, you had better be serious, because there is a consequence.” The consequence is that a yacht’s value is affected by an accepted contract, especially when the contract price reflects any reduction from the listing price. And if a buyer plays that game, he is at risk for the amount of the deposit he should have paid.

New Provision: The buyer warrants that he is not relying on any representations by the seller or the broker: Paragraph 10 was revised to make it clear that a buyer warrants he is not relying on any representation made by the seller or the broker. The previous version only included the broker. This change puts an accent on the concept that the sale truly is “as-is” and the buyer can’t rely on anything other than what is in the PSA.

New Provision: The prevailing party in any litigation arising out of the PSA is entitled to expenses, attorney’s fees, and costs for all pretrial, trial, and appellate proceedings: The attorney’s fee provision in paragraph 16 is new to the PSA. The addition of this provision discourages frivolous lawsuits, or parties taking unreasonable positions, because if there is going to be a lawsuit, the losing party will have to pay the costs and attorney’s fees of the prevailing party. 

New Provision: All notices are effective upon delivery with proof of delivery retained. Notice is no longer accepted by U.S. mail: The notice provision in paragraph 16 was modernized to conform to today’s business standards. The update removed the option to provide notice by U.S. mail and made notice effective upon delivery with proof of delivery retained. This change was also incorporated into paragraph 16 of the Listing Agreement. This should eliminate arguments about whether or not proper notice was given.

Listing Agreement Updates

New Provision: The term of the listing is now one year and it automatically renews for successive one year periods. After the first year, either party may terminate the Listing Agreement with 30 days’ written notice: Previously either party could terminate the listing after 180 days with 90 days’ written notice. The change to paragraph 9 makes things simpler by extending the time before termination is allowed to one year and shortening the number of days required for written notice of termination.

New Provision: A commission is due to the broker if within six months after the listing ends the seller sells the yacht to any party to which the broker physically showed it. At the seller’s request, the broker must provide a list of persons physically shown the yacht: Previously a commission was due to the broker if within two years of the listing ending the seller sold the yacht to a buyer whom the broker or a sub-broker showed “or provided information”. Also, under the previous version, no commission was due to the broker if the seller relisted and sold the vessel through a different broker.

The update to paragraph 10 of the Listing Agreement significantly changes this provision. The time frame for which the seller is responsible for a commission is tightened and there is a new requirement that the broker must have physically shown the vessel to that buyer. If requested, the broker must give the seller the list of persons to whom it physically showed the yacht – so it’s a very good idea (it should be a requirement of each brokerage house) that every broker keep such list. In addition, the new language provides that a commission is due to the broker even if the seller relists the vessel with a new broker.

Yacht Brokers Associations Hit With Price-Fixing Conspiracy Suit

A group of yacht organizations and brokerages are facing a proposed class action accusing them of an agreement that resulted in inflated costs for the sale of vessels.

The International Yacht Brokers Association, the Yacht Brokers Association of America, and several large yacht brokerages enforced an agreed-upon rule requiring sellers to pay higher commissions to buyers’ brokers, according to a complaint filed Thursday by yacht seller Ya Mon Expeditions LLC in US District Court for the Southern District of Florida. The arrangement made the cost of selling a boat much higher than it ought to be, the plaintiff alleged.

The documents claiming to show the yacht purchases were fabricated. They include an outdated name and logo of a yacht association that supposedly approved the purchases.

In the two years since Russia invaded Ukraine, the United States has sent Ukraine more than $75 billion in military and humanitarian aid. But some social media users are claiming Ukrainian President Volodymyr Zelenskyy is misusing the funds.

A Feb. 19 Instagram post shared an excerpt from a Nov. 27 episode of the "Redacted" podcast in which co-host Clayton Morris said Zelenskyy "somehow managed to buy two multimillion-dollar yachts … totaling $75 million." (Redacted removed this episode from its YouTube and Facebook accounts. Copies and a transcript of the video are still available online.)

Morris cited documents that he said showed Zelenskyy purchased two luxury yachts, "Lucky Me" and "My Legacy," in October 2023 using two associates as proxies.

"Americans, of course, are paying for this luxury, though. Your tax dollars, so Zelenskyy can live in luxury," said Morris, who has previously shared false claims about Zelenskyy, including that he was becoming a U.S. citizen .

The Instagram post’s caption said, "It’s a good thing that we’re able to give the president of the #Ukraine #billions of dollars to buy these #yachts and live an extravagant lifestyle. I mean, to fight a #war against #Russia."

The post was flagged as part of Meta’s efforts to combat false news and misinformation on its News Feed. (Read more about our partnership with Meta , which owns Facebook and Instagram.)

The purchase documents are inauthentic as they include outdated information. The yachts purportedly bought by Zelenskyy’s associates are still for sale.

The documents are titled "Memorandum of Agreement approved by the Mediterranean Yacht Brokers Association." However, the organization that supposedly approved this 2023 sale changed its name to MYBA The Worldwide Yachting Association in 2008. MYBA also uses a different logo now than the one shown on the documents.

The two yachts were supposedly purchased by Boris and Serhiy Shefir, close friends and business partners of Zelenskyy’s. Before Zelenskyy was elected Ukraine’s president in 2019, he and the Shefir brothers worked together at the film production company Kvartal 95 Studio.

Boris Shefir supposedly purchased the yacht called "Lucky Me" for $24.9 million on Oct. 18, 2023, one of the documents says. However, as of Feb. 21, the luxury yacht company BehneMar still listed the yacht for sale for 19 million euros, or about $20.5 million U.S. dollars.

A week after Boris Shefir’s purported purchase, Serhiy Shefir supposedly purchased the  "My Legacy" yacht for $49.75 million on Oct. 25, 2023, the other document says. However, as of Feb. 21, this yacht was also still listed for sale for about 45 million euros, or about $48 million U.S. dollars.

Although these purchases were fabricated, Zelenskyy’s financial relationship with Boris and Serhiy Shefir has been called into question in the past.

In 2021, the Pandora Papers revealed that a month before Zelenskyy was elected president, he transferred previously undisclosed shares in an offshore company, Maltex Multicapital Corp., to Serhiy Shefir, who later joined Zelenskyy’s administration. Boris Shefir was also a part-owner of Maltex, but he said he was unaware of the offshore arrangement, the nonprofit Organized Crime and Corruption Reporting Project reported at the time.

Multiple government agencies and hundreds of personnel are overseeing the U.S. aid sent to Ukraine. Experts told PolitiFact in February 2023 that there are checks in place to prevent misuse, such as funneling economic aid through the World Bank and humanitarian aid through nongovernmental aid groups.

The Senate recently passed a $95 billion emergency spending package that would allocate additional funding to support Ukraine, as well as aid for Israel and Gaza. But the package faces Republican opposition in the House.
