Nederlandse jachtenbouwer met Russische eigenaar vreest voor faillissement

Heesen Yachts, een grote scheepsbouwer uit Oss die luxe jachten voor de rijken der aarde bouwt, dreigt failliet te gaan, zo stelt het zelf. Het bedrijf heeft een Russische eigenaar en staat daardoor op de Australische en Britse sanctielijst. Een poging om de aandelen van de Rus aan een stichting over te dragen, is mislukt. De notaris zag het als een poging om de sanctieregels te omzeilen en mag hier vanwege een gedragscode niet aan meewerken.

Heesen Yachts legde de zaak voor aan de rechter. De jachtenbouwer wilde dat de notaris het risico dat het bedrijf failliet zou gaan en dat duizend medewerkers hun baan zouden verliezen, mee zou wegen bij haar besluit. De rechter gaf echter de notaris gelijk . Corrine Holdinga van het Amsterdamse notariskantoor HMK heeft juist gehandeld. 

Of de jachtenbouwer uit Oss nu in hoger beroep gaat is onbekend. Advocaat Joris de Wilde mailt die vraag 'vanwege zijn beroepsgeheim niet te mogen beantwoorden' en laat een woordvoerder terugbellen die stelt dat het bedrijf 'geen commentaar geeft'. Daar komt later een mail achteraan.

'Oplossingen'

"In aanvulling op ons gesprek van zojuist kan ik nog toevoegen dat 'er momenteel naar verschillende oplossingen wordt gekeken'," zo staat daarin.

De scheepswerf is terecht bezorgd over de toekomst van het bedrijf, zo stelt de rechter nog. Maar bij deze rechtszaak zijn de belangen van Heesen en haar werknemers niet relevant. De rechter toetst alleen of de notaris terecht geweigerd heeft.

Heesen Yachts is al vijftien jaar in handen van Vagit Alekperov en zijn vrouw en zoon. De Rus is   oprichter van Lukoil, de op een na grootste oliemaatschappij van Rusland, waar hij vorige aftrad als topman maar nog wel aandelen van bezit. Volgens Forbes is de schatrijke Alexperov ruim 20 miljard euro waard.

Alekperov behoort tot de inner cirle van de Russische president Poetin, zo kwam bij de rechtszaak aan de orde. Hij staat al op de Britse en Australische sanctielijsten. Dat zorgt ervoor dat leveranciers van de jachtenbouwer uit het Verenigd Koninkrijk hun leveringen hebben stopgezet en dat bepaalde klanten geen termijnbetalingen meer mogen doen. Ook vreest Heesen Yachts dat het bedrijf niet meer wordt toegelaten op grote jachtshows.

Er gelden vanwege de oorlog in Oekraïne sancties vanuit de EU tegen Rusland. Er is een uitzondering op brandstof en voedselproducten en ook veel oligarchen worden nog met rust gelaten door Europa. Diverse lidstaten willen echter de sancties aanscherpen, omdat Poetin nog altijd niet inbindt in Oekraïne.

Heesen Yachts is bang dat de problemen nog groter worden als Alexperov in de toekomst ook op de sanctielijst van de EU komt te staan.

'Faillissement onvermijdelijk'

"Een faillissement van de scheepswerf lijkt dan onvermijdelijk, waardoor de werkgelegenheid van ongeveer 1.000 medewerkers (500 in vaste dienst, 500 ingezet op basis van een overeenkomst van opdracht of via een uitzendbureau) in gevaar komt en waarvan ook toeleveranciers de dupe worden", zo stelde advocaat Joris de Wilde bij de rechtszaak.

Reden genoeg om snel de banden met de Russische eigenaren te willen verbreken, maar dan moet de notaris wel meewerken. De transactie is volgens De Wilde niet verboden en ook worden er geen mogelijke sancties mee omzeild, zo meent hij.

Holdinga denkt daar anders over en beroept zich op de instructies van de Koninklijke Notariële Beroepsorganisatie (KNB). "Soms is sprake van een vermoeden dat iets niet goed zit. Het vermoeden dat sancties omzeild worden is voldoende om de opdracht te moeten weigeren", aldus die instructies. Holdinga raadpleegde nog andere notariskantoren die er hetzelfde over denken.

Weg bij Lukoil

Overigens maakte Alekperov anderhalve week geleden bekend dat hij aftred als directeur bij Lukoil. Hij heeft nog wel een belang in het bedrijf. Ook riep hij op de oorlog in Oekraïne te beëindigen. Lukoil zelf deed een vergelijkbare oproep in maart.

Heesen Prepares for Busy Year with Four Major Superyacht Launches Planned

Dutch shipyard Heesen Yachts has revealed that it is preparing for a busy 2023, with 15 superyachts currently under construction and four major superyacht projects set to be launched throughout the year.

Despite what was, according to Heesen, a tumultuous 2022 year for the Dutch yard, 2023 is set to be one of its best yet. With an impressive 15 superyachts currently under construction at its facilities in the Netherlands, Heesen has revealed that remarkably, four of these are expected to launch over the course of this year. ' With fifteen yachts under construction and a workforce of 1,000 skilled people, our shipyard is as busy and well-organised as a beehive,'  stated the yard in a statement released at the start of the year.

The first of the highly anticipated vessels from Heesen which is due to launch at the end of the month, is the 59-metre Project Skyfall . Sold in 2019, the all-aluminium, high-speed vessel has been described by the yard as a ‘sport fisherman in yacht disguise’, and is complete with a seaworthy ​​cockpit, fighting chair and storage for 40 rods.

Skyfall’s extraordinary top speed of 37 knots is complimented by a striking ‘Desert Tan’ exterior by Omega Architects, with her yet-to-be-revealed interiors designed by Harrison Eidsgaard. Powered by four MTU 20V4000 engines which produce an incredible 22,000 horsepower, when complete at the of the month Skyfall will be Heesen’s most powerful yacht to date.

The second launch for the Dutch yard is the 67-metre custom superyacht Project Sparta . First presented to the industry at the 2018 Monaco Yacht Show, Sparta marks the second collaboration between Heesen and British design studio Winch Design. The 67m Steel FDHF yacht features an ‘assertive’ exterior design, ​​characterised by a strong bow, curved lines, dramatic windows and an inviting stern area. Sparta also features a stepped aft deck and a 6.5-metre infinity pool. The yard praised her raised pilothouse design from Winch as a showcase of a  ‘new style of sporty profile which will pave the way for the next generation of Heesen yachts’ . 

The impressive Heesen launches during 2023 don’t stop there. The first in the restyled 55-metre Steel Series, Project Apollo , is set to hit the water during autumn this year, showcasing her ‘aggressive’ Omega Architects-penned profile and stand-out additions. Apollo’s fuel-efficient Fast Displacement Hull design, ocean-crossing range and stylish interior design by Luca Dini Design & Architecture make her yet another incredible Dutch-built yacht.

The last scheduled launch of the year from Heesen Yachts is the 50-metre hybrid ‘smart custom’ superyacht, Project Oslo24 . Commissioned in 2021 by an ‘experienced yachtsman’, Project Oslo24’s new owners opted to have the intelligent Heesen hybrid propulsion system onboard, to allow for the ultimate luxury of silent cruising at a speed of up to 8.5 knots. Her exterior design has been based on Heesen’s popular, Clifford Denn-designed, 50m Steel Series, and her interiors have been crafted by Luca Dini Design. 

As Heesen approaches its 45th birthday this year, the industry can expect plenty more from the Dutch yard, with ‘ground-breaking’ news set to be revealed at the Monaco and Fort Lauderdale yacht shows.

Niels Vaessen takes the helm at Heesen Yachts

From 1 November, Niels Vaessen will be the new CEO of Heesen Yachts. Vaessen has served as CFO of the yacht builder for more than a decade and now takes over from Arthur Brouwer.

Vaessen joined Heesen in 2012 as finance manager after working at PwC for eight years. In 2013, the board appointed him as the CFO, a position he still holds today.

Brouwer has been at the helm of Heesen since 2014. Under his leadership, the shipyard strengthened its position as a leader in the superyacht industry and modernised its portfolio. Additionally, Brouwer successfully navigated the company through the challenges posed by the COVID-19 pandemic and the conflict in Ukraine.

Healthy order book

With a workforce of 1000 people, Heesen builds full-custom superyachts and series on speculation from 50 to 80 metres in steel and aluminium. Heesen looks confidently into the future with a healthy order book of fifteen yachts whose deliveries span through 2027. Brouwer leaves a healthy company with an annual turnover of approximately EUR 200 million.

At the same time, Supervisory Board Chairman Anjo Joldersma has also indicated that it is time for his retirement. From November 1, Adse de Kock will be the Supervisory Board Chairman.

Sea trials commence for Heesen's 55M Steel Superyacht IRIS BLUE

IRIS BLUE, the latest 55m (180.5ft) Heesen superyacht , has been observed embarking on her sea trials in the North Sea. Designed for waterfront living with a beach club and seamless access to the sea, she is scheduled for delivery later this year.

Formerly known as Project Apollo, motor yacht IRIS BLUE  showcases the "evolutionary" design inherited from the preceding Heesen 55M Steel Class . Although she stands as the inaugural superyacht in the series to feature the revamped exterior lines.

Maintaining the Fast Displacement Hull Form (FDHF) crafted by Van Oossanen Naval Architects, complemented by exterior design courtesy of Omega Architects and interior design meticulously crafted by Luca Dini Design & Architecture.

Providing all guests with incredible sweeping views of destinations like Ibiza and Croatia , the sundeck is the crowning glory on board the motor yacht with a wrap-around bar, complemented by a whirlpool Jacuzzi. The atrium showcases a modern design, with wider staircases that facilitate seamless crew movement from the sun lounge to the sundeck.

The main salon boasts floor-to-ceiling windows with few mullions, creating an assertive aesthetic, and idyllic viewpoints for making the most of the Mediterranean scenery. This effect is accentuated by the continuous tinted windows that extend the entire optical length of the yacht.

Offering comfortable accommodation for up to 12 guests in a six-cabin layout, motor yacht IRIS BLUE features a spacious owner's suite on the upper deck with a French balcony.

Heesen Yachts: Building a Legacy

Heesen Project Cosmos

This past summer, a handful of cranes lifted the massive aluminum superstructure for Project Cosmos into the air at Heesen Yachts , in preparation for joining the superstructure with the aluminum hull. The 1,700-gross-ton 262-footer is the largest yacht by volume and length in the Dutch shipyard’s history.

As exciting as the moment was for those reasons, it was arguably more exciting for the builder’s team because of Project Cosmos’ challenging construction and engineering. Incorporating a shipyard-patented hull component, the yacht is poised to cruise upward of 20 knots and top out at 30 knots.

The excitement in the air may have been reminiscent of a similar scene in 1979, when the 66-foot <i>Amigo</i> launched. <i>Amigo</i> was by far the largest yacht that a Dutch entrepreneur, Frans Heesen, had built. It was also the first yacht under his then-fledgling brand, Heesen Yachts.

Heesen Project Cosmos

With a business background in plastics, he had acquired the Striker Boats shipyard in 1978, initially for other purposes but ultimately deciding to keep boatbuilding operations going. He prioritized constructing aluminum yachts and marrying performance with luxury. In the ensuing years, Heesen Yachts earned a global reputation for both sport-fishing and performance designs.

While Frans Heesen sold the yard in 2008 and retired in 2012, the company hasn’t retreated from its pioneering path. During the past decade, it has delivered about two dozen aluminum yachts between 121 and 230 feet, as well as 18 steel-hulled yachts up to 184 feet length overall. While most have been semicustom and started on spec, Heesen replaces models regularly and is increasingly pursuing fully custom projects.

Heesen Project Cosmos

The builder can work on as many as eight yachts annually and is aiming for a larger share of the supersize-yacht market, with a 279-foot-long dry dock within a 295-foot-long construction shed. And Heesen Interiors recently added 24,000 square feet to its headquarters. The site now encompasses nearly 87,200 square feet. Staffed with draftsmen, cabinetmakers, wood finishers, upholsterers and more, Heesen Interiors is among the few full-service interiors departments under a superyacht shipyard’s ownership.

“It’s a constant evolution at the shipyard to try to stay current—because technology changes,” says Thom Conboy, US director of sales. Building on spec can run the risk of doing things the same way again and again, “but to try to continue to be on the cutting edge with spec boats is a fine balance between innovation and profit.”

Heesen Project Cosmos

A good example of striving for innovation is Heesen’s use of the fast-displacement hull form. Designed by Van Oossanen Naval Architects, it reduces hydrodynamic resistance throughout a yacht’s full speed range and reduces fuel consumption by about 15 to 20 percent. Heesen became the first builder to adopt it with the 213-foot <i>Galactica Star</i> in 2013. The hull form is now standard on several of Heesen’s series models in aluminum and steel.

The shipyard also adopted technical advances such as the Hull Vane, another Van Oossanen creation. Like a spoiler on a car, the Hull Vane is a foil, or a wing, that helps to create thrust while reducing drag, pitching and fuel consumption. The steel-hulled <i>Alive</i>, a 139-footer started on spec and delivered in 2014, was the first yacht to use the Hull Vane.

“With these spec boats, we’re not one of those shipyards that set out to build a run of 20, 30, 40 sisterships,” says Mark Cavendish, Heesen’s director of sales and marketing. Heesen limits each series to about 10 to 12 yachts, sometimes even fewer. “Then we’ll stop and redesign and engineer a whole new model. We’re not just taking the hull and tweaking it slightly; we’ll actually tear up the blueprints and settle down and look at what the latest technology can offer owners.”

Then, the Heesen team adds in owners’ ideas. “We’re known to be a flexible yard,” Conboy says. “If it makes sense and helps the sale, we’ll look at it.”

Heesen Project Cosmos

Even with its history of series builds, Heesen is fielding requests for fully custom yachts. Two notable contracts are Project Skyfall and the above-mentioned Project Cosmos. The latter’s quadruple MTU engines totaling 19,000-plus horsepower are expected to deliver a punch that requires rigidity and light weight in the yacht’s construction. Heesen’s in-house solution is a patented structure called the Backbone. Similar to an I-beam, the top of the Backbone runs port to starboard on deck, while the bottom forms the keel. The yacht’s hull spans the middle. Upon delivery in 2022, Project Cosmos should be the fastest all-aluminum yacht of its size.

That’s more than “something fresh in the offing,” as Cavendish describes Heesen’s operations. It’s bound to be a stiff breeze blowing customers’ hair straight out.

OSS – Superyacht builder Heesen Yachts launched its steel Project Oslo24 in the presence of the owners, family and friends.

The yacht was christened Cinderella Noel IV. The round-bilge, 50m (164ft) vessel is a fine example of what clients who opt for a Heesen ‘Smart Custom’ yacht can expect:  a solid, proven engineering platform in a spec-built yacht.

“Our Smart Custom proposition has an excellent track record,” says the yard. “These yachts are fully engineered above and below the main deck but can be offered with a custom-designed superstructure. This means we find a smart balance between proven performance, speed of delivery and customization.

Cinderella Noel IV has a flybridge, hybrid propulsion, a glass-bottom pool, and an outdoor fire pit and will be delivered in March.

Heesen Chief Commercial Officer Mark Cavendish said, “Cinderella Noel IV is imbued in every detail with the owners’ passion and experience. The energy they have put into creating a yacht that perfectly suits their lifestyle is impressive. They carefully considered every choice and worked closely with our team of experts to find the most intelligent solutions.”

The owner wanted a second steering position on the flybridge and had a flight of stairs installed to move between the flybridge and the wheelhouse.

The yacht’s hybrid propulsion is a first-time installation for Heesen, along with a foldable mast to navigate bridge passages and channel navigation lights for the planned canal and lock passages.

The owners worked closely with Luca Dini Design and Architecture and Heesen’s engineering team to create a layout that suits their life on board, conceived for extended stays with his and her working spaces.

“This project has been a unique experience,” said Silvia Margutti of Luca Dini Design and Architecture, “driven by the owner’s passion and the shipyard’s expertise, with every detail analyzed and agreed with the clients.”

The yacht’s interior décor is Scandinavian chic, marked by white, greige, and taupe furnishings and high-gloss Indian rosewood and dark oak flooring.
