Family speaks as new video shows man who drowned in Biscayne Bay after jumping off yacht

The video has no audio, but appears to show Tong in the water struggling to tread choppy waters back on March 18.

According to the lawsuit, Tong and 12 other passengers boarded the yacht Victoria at the Jones Boat Yard located at 3399 Northwest South River Drive in Miami to cruise around Biscayne Bay.

“Drinking alcohol was not only tolerated but it was encouraged," said Pedro Echarte, an attorney for the family. "Enoch was only 20 years old that day. Not old enough to legally drink when he lost his life during that charter.”

The lawsuit states that it is believed that while the yacht was anchored, Tong jumped off, was caught in a rip tide and began to struggle to remain afloat.

“We do know that his friends did throw life preservers they tried to help him but unfortunately, the current was just too strong,” Miami Fire Rescue Lt. Pete Sanchez said at a news conference back in March.

With the assistance of the Miami Fire Department, the Coral Gables Police Department and Miami Police Marine Patrol Units, Miami Police found Tong's body the following day in the water just west of the Rusty Pelican.

The Tong family spoke for the first time Wednesday following the incident and are demanding safety changes in the charter boat industry.

"He was very honorable. I know a lot of mothers and parents say how great their kids are but Enoch was a great child and um, we’re really going to miss him," mother Mattie Bess said. "I just hope this doesn’t have to happen to another family."

According to the lawsuit, the Tong family believes Enoch’s death could have been prevented by the professionals operating the boat charter.

In a lawsuit filed in Miami-Dade County, the family alleges multiple defendants failed to reasonably and properly train, instruct and supervise its employees, agents, contractors, crew members, or seamen, including the captain and first mate; failed to properly equip its vessel with the proper safety and equipment; and failed to properly use the available safety and lifesaving equipment aboard the Victoria .

“When they saw Enoch struggling, instead of a crew member putting on a life jacket, jumping in the water with a life jacket to give to Enoch, she took minutes to find a life ring," said attorney Joshua Padron, who represents the Tong family. "Instead of jumping with the life ring she threw the life ring in the water, five feet away from the boat.”

Attorneys for the victim’s family said although Tong was capable of swimming, the boat crew never alerted passengers about the hazardous water conditions or even held a safety briefing.

“The amount of time is staggering before the captain even realized what was happening," Padron said.

The lawsuit seeks damages in excess of $50,000. NBC6 has reached out to the charter company and was awaiting a reply.

On the day Tong's body was recovered, the U.S. Coast Guard expressed their sentiments in a post on X, offering their condolences to his friends and family.

Family Sues Boat Company After 20-Year-Old Jumped Off Yacht and Died in Florida Waters

An attorney for Enoch Tong's family alleged in a press conference Wednesday that the yacht crew did not warn the victim of the risk of jumping into the water

A family is suing a yachting company, as well as other companies and individuals, for negligence after their loved one jumped off a yacht and drowned in the waters of Florida’s Biscayne Bay in March.

The lawsuit filed in Miami-Dade County by an attorney on behalf of the family of Enoch Tong, alleged that the victim, Tong, and 12 other passengers were aboard the yacht Victoria on March 18, 2023, for a chartered cruise around Biscayne Bay.

While docked in the bay, Tong, 20, jumped off the boat “when he was caught in a rip tide and began to struggle to remain afloat," according to the complaint, which also alleged that "as a direct and proximate result," Tong "drowned and sustained severe injuries resulting in his death on March 19, 2023."

The complaint said that his body was found the day following the incident.

During a press conference on Wednesday, shared by local news outlet WPLG , attorney Pedro Echarte said that, "on March 18, 2023, Enoch Tong and his friends chartered a vessel from Impulsive Life LLC and its owner Darien Fresco, who are named defendants in this lawsuit."

Echarte claimed that after several hours of cruising around the Bay, the boat was anchored.

He said that the currents were strong and ripping at the time of the incident, and alleged that "neither the captain nor the mate aboard that vessel warned Enoch or any of the passengers of the swimming hazard that existed.”

He then said that Tong had jumped into the water and begun to struggle.

Mattie Bess, Tong’s mother, also spoke at the press conference, recalling the last time she saw her son that day. “Today I stand before you,” she said, “with a heart burdened by grief as a mother who has tragically lost her beloved son during a devasting incident."

"I want to ensure that no other parent has to endure the pain and heartache my family is currently going through and will go through for the rest of our lives," she added.

In the lawsuit, the family filed negligence claims against Impulsive Life LLC, Starward Yachts Inc, Jones Boat Yard Inc, multiple "acts and omissions" including: “failing to reasonably and properly train, instruct or supervise its employees, agents, contractors, masters, officers, crew members, or seamen”; “allowing unqualified and untrained employees, agents, contractors, masters, officers, crew members, or seamen to operate the Victoria”; failing to properly equip or use the available safety and lifesaving equipment aboard the Victoria”; “failing to implement reasonable and proper safety policies and procedures for its passengers (or failing to instruct its crew of the same)”; and "failing to warn its passengers of the risks of jumping in the water, especially during poor or deteriorating weather conditions."

Additionally, the complaint made negligence claims against multiple individuals, including crew members on the boat. The family is seeking damages in excess of $50,000, "exclusive of interest, costs, and attorney’s fees."

According to the suit, the plaintiff, "demands a trial by jury of all issues triable as of right by a jury."

At a news conference in March, Miami Fire Rescue Lt. Pete Sanchez said, per NBC affiliate WTVJ : “We do know that his friends did throw life preservers they tried to help him but unfortunately, the current was just too strong.” 

WSVN reported that a police investigation was launched in March but no one was charged. 

PEOPLE has been unable to find contact information for Impulsive Life, LLC. Starward Yachts did not immediately respond to PEOPLE's request for comment. Jones Boat Yard was not immediately available for comment when reached by PEOPLE.

The family of a 20-year-old man who was on vacation last March and jumped into Biscayne Bay on a chartered cruise boat is now suing the charter company. Enoch Tong of Cumberland, N.C., ended up dying after getting caught in a rip tide and, according to the lawsuit, the boat’s crew failed to help save him.

At 4 p.m. on Saturday, March 18, 2023, Tong and 12 other people boarded the 65-foot yacht “Victoria” at the Jones Boat Yard at 3399 NW South River Drive, Miami, according to the Haggard Law Firm which is representing the family.

The boat made its way through the Miami River. At around 6 p.m., it stopped to anchor by Marine Stadium in Biscayne Bay.

According to the law firm, while anchored in Biscayne Bay, Tong jumped off the yacht and was caught in a riptide. Fast rip currents and high winds took him away from the vessel. His body wasn’t discovered until the next day on Saturday, March 19, 2023.

The Tong family believes Enoch’s death could have been prevented by the “professionals” operating the boat charter who were aware of the dangers of letting him get into the water.

A press conference held Wednesday announced the lawsuit against the charter boat company.

Also, the charter boat company promotes that guests bring their own alcohol and commits in one rental listing that “stewards will make sure your cup always remains full to ensure you a great time,” stated the law firm.

The firm also pointed out that Tong, at 20 years old, was under the legal drinking age, but yet was allowed to drink aboard the boat.

The law firm says the family is demanding safety changes in the charter boat industry. Tong’s family says captains and crews must be responsible for identifying impaired passengers and either stop the charter if someone is drunk or closely monitor the intoxicated individual before tragedy strikes.

• Failed to reasonably and properly train, instructor supervise its employees, agents, contractors, crew members, or seamen, including its Captain, Jose Carlo Arroyo, and its First Mate, Madlen Abou
• Failed to properly equip its vessel with the proper safety and equipment.
• Failed to properly use the available safety and lifesaving equipment aboard the Victoria.
• Failed to implement reasonable and proper safety policies and procedures for its passengers (or failing to instruct its crew of the same);
• Failed to implement safety policies and procedures regarding emergency situations.
• Failed to provide safety instructions and briefing to its passengers, including safety instructions and briefing concerning what to do in emergency situations.
• Failed to check the water and weather conditions both before and during this specific Charter tour.
• Failed to warn its passengers of the risks of jumping in the water, especially during poor or deteriorating weather conditions.

Speaking at the press conference, Tong’s mother, Mattie Bess, said “we must come together as a community united by a common purpose taking meaningful steps to prevent such tragic incidents from happening again.”

A uthorities are continuing their search for a boat that struck and killed a girl in Biscayne Bay on Saturday afternoon as new photos show the aftermath of the tragedy.

The young girl was identified as 15-year-old Ella Riley Adler , who was a student and an accomplished ballet performer, according to Ransom Everglades Head of School Rachel Rodriguez.

Officials said the boating incident happened near Nixon Beach in Miami-Dade County around 4:30 p.m.

The girl had been waterskiing before she was struck by a vessel, Florida Fish and Wildlife Conservation Commission officials said.

On the condition of anonymity, NBC6 spoke to a witness who offered a firsthand account of the tragic incident.

The witness also provided NBC6 a photo of the immediate aftermath, which captured what appeared to be gray yacht next to a police boat. The witness said the victim was waterskiing from the gray yacht.

According to the witness, the girl was in the water when she was struck by a large center console fishing boat. They said boat that hit the victim did not appear to swerve or slow down. Following the collision, the witness said they heard distress signals and screams over the radio coming from the yacht.

Officials also said the vessel that fatally hit her was described as a light blue center console, possibly with blue or dark blue bottom paint and three or four white outboard engines. It was last seen heading westbound from Nixon Beach in Key Biscayne.

FWC officials also confirmed to NBC6 on Sunday that the girl was not actively waterskiing when she was hit.

“The victim was waterskiing. And at the time of the impact, she was not actively waterskiing. She was just in the water with the board attached to her feet and wearing a life jacket," an FWC spokesperson said.

The witness described the yacht as urgently blaring its horn while circling back to the girl.

The FWC says a reward of up to $20,000 is being offered for information leading to an arrest or aiding the investigation.

Miami Biscayne Bay Cruise  🛥

Get a taste of Miami on a  Biscayne Bay Cruise on our double-decker boat. During this 90-minute Miami Biscayne Bay boat tour, you’ll see the lavish homes of the rich and famous, beautiful beachfront properties and one-of-a-kind views the dazzling Downtown Miami skyline. Whether you’re a history buff, nature lover, architecture enthusiast or just curious how the celebrities live, this is the cruise for you.

What You’ll See

Our 90-minute Biscayne Bay Cruise Tour begins at Downtown Miami’s Outdoor Shopping Mall — Miami’s home for exciting dining and name-brand shopping outlets. After circling around Port Miami, we’ll cruise past Fisher Island’s coconut palms and mangroves. On the opposite shore, the historic architecture of Miami’s Art Deco District basks in the sun.

Next, we pass Star Island, a man-made island home to Miami’s rich and famous, including:

• Gloria Estefan
• Sean “Diddy” Combs
• Jennifer Lopez

If those names don’t entice you, keep an eye out for the former home of underworld legend Al Capone. There’s no better way to feel like you’re in Miami Vice or Scarface than with a Biscayne Bay Boat Tour  (there’s no better legal way, anyway).
